🚨 ICE arrested an illegal immigrant in Fairfax County. DHS says Walvin Victor Hugo Garcia had been arrested in June of 2025 for felony charges of rape of a child less than 13 years of age, aggravated sexual battery of a victim under 13 years of age, use of a computer to commit sex offense with a minor, and distributing drugs to a minor.

DHS says following his initial arrest in June, ICE lodged a detainer asking "Fairfax County sanctuary politicians to not release this illegal alien from jail back onto the streets. Unfortunately, sanctuary politicians REFUSED to cooperate with ICE. Garcia was allowed to leave court without ICE being notified."

“Governor Spanberger and her fellow sanctuary politicians in Fairfax, Virginia refused to cooperate with ICE and RELEASED this child rapist from jail back onto the streets,” said Acting Assistant Secretary Lauren Bis. “This criminal illegal alien from Guatemala has been charged with raping a child under 13, aggravated sexual battery of a victim under 13, and distributing drugs to a minor. Thanks to our brave law enforcement, this sicko is out of our communities. Governor Spanberger and Fairfax sanctuary politicians are playing Russian roulette with American lives by releasing criminals from jail into American neighborhoods.”

DHS added: "Garcia first came into the U.S. illegally near Eagle Pass, Texas in October of 2023. He was then released by the Biden administration into the country. In February of 2025, an Immigration Judge in Virginia issued Garcia a final order of removal.

During her first days in office, Governor Spanberger signed executive orders banning state cooperation with ICE as well as terminating 287(g) state and local agreements."

How did Governor Spanberger release a criminal before she was inaugurated?

ICE arrested him following an appearance in court on May 1. Fairfax County released him after his court appearance. Fortunately ICE was there to take him into custody. Why would anyone want him walking the streets?

Why wasn’t he arrested in 2025, when the removal was issued? Why didn’t Youngkin sign an EO mandating the cooperation between districts and ICE? Why blame Spanberger?

He did. EO 47. Covered VSP and correction agencies. Encouraged localities to fully cooperate.

Fairfax county has never fully cooperated with immigration. And then they have Descano to ensure these criminals walk free.

. But not mandated. Again, why was the perp not detained by ICE in 2025? I mean, he attended his hearing, so he was around…

So you’re saying Trump’s ICE was ineffectual to get the job done, which was to get a criminal illegal with a removal order deported. Despite the billions of dollars we give them, they need county prosecutors to do their jobs for them. Got it.

How she handles the bills sitting on her desk that were returned after the special session will determine just how hard the remainder of her term will be. Might not even make it through the first year.

I love how the MAGAs try to blame Youngkin’s failures on Spanberger.

Classic GOP projection.
