Company pays for cell phone...

I believe his phone is actually on the company account. Does that mean they can see his texts?
Anonymous
Not usually but really, stop sexting his work cell.

But really. Is there a way for me to know?
Anonymous
Probably not in real time, but they have a right to go through them.

No, it's company specific. He should know, though, as companies are typically transparent about it with the employees.

Employers aren't generally trying to catch employees misbehaving, they're trying to prevent misuse of company assets. Monitoring is usually used as a deterrent of bad behavior. That only works if people know they're being watched. Mine, for instance, lets us know our overall data usage is monitored and people using too much will be asked to explain/justify. So in my case, I know they care if I use more than 2 GB per month but not really what I'm using the data for so much.

No. We (work) tried and were told we needed a warrant.

In terms of active monitoring, it depends on who he works for. A 3 letter agency? YES. But the texts are owned by the company and they can look at them at any time, for any reason.

Don't talk about private stuff on there. And for all that is holy, don't send dirty photos or browse elicit websites with his work phone. That's just monumentally stupid.

It's hard to get those records. At my company there was an allegation of sexual harassment via company cell. Company asked provider to hand over texting records and was told not without a warrant.

I assume company can confiscate and go through the phone they own at any time, but once texts are deleted, they'd need a warrant to get them from the provider.

Yes true. In this case the texts were from months back and probably deleted. I don't have access to all the facts of whether they confiscated the phone. In any case, he messed up another time thru email and was fired.

There's always a log of everything sent to and from his phone on record with the carrier, but if you're concerned about privacy you should have him get a personal cell phone for use with you and his personal contacts. Work phone shouldn't be for personal use anyway.

This is why I maintain a personal phone. I used it to check the company email, the TOS with the company is that they can require security settings, but they have no rights to my actions. I could get a company phone, but it would not save me anything, and I would have two devices.

I don't think OP is sending sexy texts to her Dh. She suspects her Dh is cheating and wants to know if his work could find out--maybe if she makes friends with or bribes someone in the office they'll be able to fill her in.

More like OP is the OW. A wife would know if the phone is a company paid phone or not.

Why would the OW care?
