Information about frozen bank account and garnishment?

My father is saying his bank account was frozen and the funds drained and that he has a garnishment of wages, but that he did not have a court date. All my research says that only a judge can issue this to a debt collector. He lost his home and has a po box so I believe he is receiving summons to appear at his old address but not getting them. I believe this means he will have a failure to appear warrant issued?

He is never truthful with me so I have no idea what to believe. He also lost his house to foreclosure that he said he had no idea was happening and that they sold it for $180000 more than he owed so he needs a lawyer to retrieve the overage from the mortgage company that is holding his money.

He also said that the mortgage company is contacting all his past debts and paying them out of the overages without his permission. I have allowed him to live with my husband and I for months now but am at a breaking point with the lying. He recuse to work and now says there's no point in getting a job because his wges will be taken immediately. What is the actual procedure for doing these things? Is he full of it??

There might not be an overage for the foreclosure after all of the fees.

Of course he's full of it. Even when wages are garnished, they don't take the full paycheck, depending on your state typically the maximum that can be garnished is 25%.

My guess is he struck a deal with a debt collector, didn't get it in writing, and gave them electronic access to his bank account. The shadier ones will clean you out if you give them electronic access. They push for it HARD and say that is the only way they can do the deal, rather than you sending a cashiers check or something.

I'd guess he is confused, overwhelmed, and not well-versed in the terms of debt & foreclosure rather than trying to sell you a sob story. But you know him best.

Yeah my dad isn't confused, I see what you're saying though. This is a guy who rips up his name on mail because of identity theft. Theres no way he gave them access to his accounts. He's very calculated and very full of it unfortunately. I think a judge might have ruled this.

Run a back round check on him...you can get all the info. They will give you a full credit history etc.

Any trouble with the IRS for back taxes? They can also garnish wages & freeze accounts.

For a summons, I think they need proof of personal service (so not just sending it in the mail). Is this in Maryland? You can look up all court cases tied to a person's name on their website.

Garnishing wont' be done for 100% of wages, so he _should_ get a job.

Tell him to give you POA so you can call on his behalf.
