| Np. Not an expert here but wondering if there is any tort law case against the parents for negligence. The parents knowingly had their unlicensed kid driving a car - which seems like pretty obvious negligence, ie. an event that could foreseeably lead to injury to someone else. This depends of course on whether the learners permit requires a licensed driver in the car. If no adult required, then there’s no case on this point. |
It doesn’t sound like OPs DW hit the gas when the light turned green (there’s no way she’d be going 35mph at that point) It sounds like she drove through a green light at 35mph (totally legal) at the same time the teen was running a red light (totally illegal). The kid is at fault and his parents insurance needs to pay. |
