OP did not say the photo was shared with the class, simply that others saw the teacher take the photo.
Regardless a photo is not documentation. ABC data is. You don't need a phot as proof, simply data and a witness if applicable. OP is leaving a lot of the story out, simply saying lawyer up isn't going to help unless more info is given. I imagine OP was denying something was happening so perhaps that's why a photo was taken. |
| I’ve had to take photos of students and classwork for my own evaluation portfolio as evidence of typos of classroom activities. Just another example where taking a photo has an innnocuous purpose. |

| Guess what folks. Do you honestly think there is anyway to keep a kid from using their phone in class. Today we have 300lb high school students who will stand to table tops. Kids that physically vandalize school and other students property. The school halls are filled with cameras and kids cut class anyway. I think if we gather evidence by photographing the student committing the offense the student may better understand there are consequences for your actions. |
No, the same rules don't apply to students and teachers. Is there any other field where people think the same rules should apply to professionals and the people they serve? |

| It makes me sad when people jump on the OP on this forum. Some of these comments, even if there’s a nugget of truth are as nastily phased as possible. And the PP who “assumed” OP was in denial, way to kick someone when they are down. Obviously the OP needed more information and I am not against photographing behavior if necessary but some of us here have had our kids really suffer at the hands of one or two terrible teachers and I absolutely can see this being used as a shame tool against a child. The one photograph we received from the shitty teacher who hated our kid was actually incredibly useful because it showed them doing something 1) inappropriate and 2) not following the commitments they had agreed to with regard to our child. |
To be clear the inappropriate behavior was the teacher shaming my child, not actually anything my kid did |

It's not illegal. It may be unethical. It might violate school policies. But it isn't illegal. |
| My DD’s karate instructor did that once. I found it very inappropriate. Yes DD needed to change her behavior and we were in it. But the karate instructor ended up getting fired after 11 years at the studio, which makes me think he was not appropriate in other aspects of his job |
