Excellent stuff - im surprised trump is doing this as he came out in support of affirmative action during the campaign.

Dept of ed is right now being sued by Princeton due to Princeton not wanted doed to release admissions data that they turned over to Doed wrt Asian quota inquiry.

Harvard and unc are facing legal action too that's currently working itself through the system.

No - if Kennedy and a liberal Scotus member get replaced, fisher II, gratz, bakke, and all other Affirmative action cases will get flipped via a new case.

It isn't nearly as strong of a precedent as roe or almost any other "norm"

Private institutions can do what they want. SCOTUS has articulated the standard in a recents string of cases for publics. What is the DOE doing again?

And BTW-- white parent here with a kid at TJ. The students who have a legit beef about being held to a higher standard in college admissions are Asians-- especially inIvys and STEM programs. My kid will get in to a college with a lower GPA and lower SAT that his Asian classmates.

But sure, affluent whites are being shafted.


No they can't. Do you think a restaurant can refuse to serve black customers? Or a school to admit black students? It's all prohibited by federal law under the commerce clause.

On the contrary.

SCOTUS actually ruled against racist AA policies, so this is just a way to make sure universities follow the law -- meaning, they don't discriminate against whites or Asians or Jews or whatever other group based on their race.

Even more clear: Why should a black student who has a 3.3 gpa, 1200 sat and who comes from an upper middle class background and has good extracurriculars get into better schools than a Vietnamese/ Filipino/ Pakistani/ Indonesian American middle class student with a 3.6 gpa, 1300 sat and good extracurriculars?

I know my pal from Iraq checks off the white box. I don't think people from Western Asia check off Asian.

Not that I think for a minute that 3.6 students are losing spots to 3.3 students. But the reality today is that black student will get 50% of the job interviews compared to a white student with the exact same resume, just a different name.
