504 for ADHD for kid with good grades

I'm in another district with a middle schooler with a 504. He has good grades and the school won't do squat. In some cases, one teacher isn't even trying to support him with extra time (as the 504 says he needs) and then will penalize him because he doesn't complete all the work on time (he needs to take some assignments home to complete, she should understand that). I've had to go to the principal, and they've done nothing. What's next, nasty letter to the superintendent threatening a lawsuit?
