this is similar to what we did, put a few items, which would never get you close to the 250K. I think the form is poorly written and instructions are garbage. If I put value of my entire house it would go way over 250K and I would owe a tax equal to my rental income. This would effectively be government banning me from being able to use my house as income property because they would take the entire income. If this is a new law, then its only purpose is to kill all private landlord activity in DC. I doubt this is the case without much political backlash.

I rent out one single-family home in D.C. and cannot figure out which "schedule" to provide in the online FP-31 form. It won't let me select "no" for all of them. Is it D1? D2? This is madness.

I think this is incorrect. Schedule D1 of the FP-31 is for the value of the real estate itself.

are you saying DC small LLs have to pay 3% annual tax on the entire value of their property? This would make you broke renting it out given property prices in DC. I don't believe this is the market value of your house. Most rentals don't produce more than 5% annual returns on the value of the property, taking most of it as tax revenue would bankrupt all DC landlords

Just got a notice of delinquency from Office of Tax and Revenue for this form I've never heard of before. Can you file a paper form or does this have to be filed online?

It's easy to file online. Unless you have a lot of personal property you won't owe anything

I received the same confusing letter for the first time ever as well. Every individual I have ever worked with at OTR has been a saint. Great folks working there. But lord that institution is confusing.

This thread was very helpful in figuring this out. I ultimately had to talk to ORT to figure out the answers for my questions. The first question "Is this the final return?" confused me. The answer to that is no (unless you are closing out a business). I put "real estate" down for my type of business and 1 for the number of locations. I was told by the ORT rep that if I have an unfurnished rental property that I can just open up any schedule (in this case she recommended the first schedule) and put down $0.00 and submit the return. You cannot submit the return without filling out at least one schedule. Hope this is helpful for others.

To those hung up on the concept of "in trust" , I believe you are misinterpreting what is almost a run-on sentence. [Individuals, Corporation, etc. and TRUSTEES THAT OWN P.P. IN TRUST]. The "in trust" verbiage is referring to the Trustees, not individuals, corporations, etc.

So yes, it does appear to apply to individuals, including small landlords, unfortunately.

There is an opportunity for advocacy on this!!!! The DC Tax Revision Commission, which advises the Council on changes to tax law and policy, is considering a proposal to either eliminate the personal property tax or reduce the filing requirements. You can comment on it at https://www.dctaxrevisioncommission.org/proposals (it's proposal B-9).

Thank you!!! This is what I needed. I was also tripped up by the final return question. Got a notice on this recently, and am now trying to resolve it so that I can renew my business license. I appreciate all of the feedback you and others have provided.

It's definitely not easy being an accidental landlord in DC.

It is funny, I was the original poster of this thread! and I have never had to do the certificate of clean hands... is this something new? I use RentJiffy to renew my DC business license and they never asked for that but always successfully renewed my BL.
