No, you don’t understand the difference between “some degree of homicide” and “summary execution.” The issue to which the relevant posts was directed was not whether, when and to what extent any given defendant formed the mens rea sufficient to support a conviction for some degree of homicide. It was whether what occurred was a summary execution. It was not. A summary execution is an execution in which a person is accused of a crime and immediately killed without the benefit of a full and fair trial. This literally is what happened to Tyre. |
