i live in NoVA. Wife and I don't agree on anything and have nothing to talk about except our kids.
I live in the basement and have no physical contact. I would like to get officially separated. How do we do that in NoVA ? |
| Call an attorney. |
| You can't in the same house in va. You kind kinda with an attorney. You have kids so you are looking at least 1 year out |
|
Do we absolutely must engage a lawyer?
Do we absolutely must not live in the save house? |
|
thanks much RHinVA.
I now know what keywords to search for and found this doc that applies for Fairfax county where i live. |
| What are you hoping to get out of an official separation? Are you planning to divorce? |
Learn English. |
As snarky as the previous poster was, he has a point in this context. There are a lot of nuances to the laws in this area, and if you misunderstand something due to language barriers, you could make quite a mess for yourself. |
Criticizing is easy, helping is harder. You alway have the choice. Show you are better not by criticizing but by suggesting or correcting his English. |
| Family courthouse. |
| Call an attorney and get a separation agreement. File it with the court in your divorce proceedings. It will be effective as of the date you choose. Since you are living in the house, that might be trickier. Are either of you planning to move out? |
| my wife lost her job 2 years ago and she's having a hard time finding one. For financial reasons, I can't easily move out. My ideal situation would be to be able to move to a place where we both could be in our own smaller house close to each other so we could still parent and be close to our kids. The only way I found so far to be able to do that is to all move to a less expensive city. She does not want to do that because of the great opportunities in the DC area. She's right but we can't continue living together like 2 strangers in the same house. I love my kids to death but I am afraid 1 day I'll have enough and just leave for another city or country. |
Yes, you can be separated in the same house in VA, I know two couples who did it this way. However, I don't know what paperwork they had to do. |
