You seem confused about GJ secrecy. Even if evidence is known publicly or by persons outside the GJ (which essentially all evidence is), it is illegal to disclose the fact that it was presented to the GJ. |

Former AUSA here. That’s basically right, but you’re missing that grand jury secrecy doesn’t apply to grand jury witnesses. Witnesses are not under an obligation to keep their testimony secret. If the USAO had an FBI agent testify in front of the grand jury, the agent could tell Patel the contents of his testimony and Patel could relay that information to the public. These people are all dirtbags, but I don’t think this is necessarily a breach of grand jury secrecy. |
