I realize all the talking heads will say it's not so, but to my knowledge, the extent of Presidential declassification authority, for classified materials that are not subject to another law or statute, has never been litigated, or even really discussed. There's certainly no statutory procedure, and there's an awful lot of Supreme Court justices that subscribe to the unitary executive theory of the presidency.

Did DOJ challenge Cannon's jurisdiction over the case? Because I would hope that's still ripe for appeal and the higher courts could use that as a get out of jail free card, so to speak.

I think the special master will find all the documents are privileged. The judge will make the DOJ give the documents back to trump.

I think what we are seeing with judge cannon ruling is scotus conservatives majority opinion on the subject. She did not write this.

No it is a victory for conservatives and the federalist society. How many of these sleeper judges are there? What are their orders and how hi controls them? Why should the DOJ go along with this judge’s crazy rulings?

She's about as qualified as I am (I'm not a lawyer, but I read about the law a lot.)

Yes, it's a victory for conservatives and the Federalist Society, but not one won on a 51-49 margin. IT WAS HANDED TO THEM. If you are in Virginia, both Warner and Kaine voted to confirm her. I'm planning to write to them and tell them that I object to the confirmation of any federal judge that professes an association with the Federalist Society. I would say I honestly don't understand why that has been tolerated, but in truth I probably understand it all too well.

Also, we need federal judicial reform. Badly. Quickly. Now.

So, both political parties and the media like to conveniently hang their hat on the ABA ratings, but everyone should know that the ABA is a voluntary professional association. It's not a governing body. It has no authority to do anything. Both parties like using its standards when it suits them, but that's about it.
