I would have to see that video. If he leaned forward with her in that open window. OMG. |
This. Even a color blind person could see and feel (the breeze) the window was open. We were on the exact same ship and got off the exact same morning the incident happened. We looked out that window each morning after breakfast to check out where we were docked. You feel the breeze as you approach the open window and you notice the pattern of open and closed windows. It’s obvious. |
And the pattern of light (open) and dark (colored glass) is not dependent on distinguishing red from green, or blue from purple. There is a light/dark pattern even if someone were only to see in black, white, and shades of gray. |

And if grandpa really did have vision issues, why on earth would he make those kinds of royally huge assumptions about windows/glass? He wouldn't reach out first (with child on the floor) and confirm that a window wasn't open? What does he do with windows at people's homes, or elsewhere?!
And even if he did have vision issues, you don't take risks with little kids! The "color blindness" claim only makes him sound more irresponsible, not less. But I think we all know the answer. He knew the window was open. He was just stupid, dangerous, and lost his grip. Fatally stupid. |
Legally, you are correct. But I think losing the grandchild and having this on his conscience forever is a punishment that's sufficient. I do think it's wrong for him and the family (and ambulance lawyer) to blame the cruise ship. |
We should do away with prisons for this very reason. The guilt is punishment enough.

Not if he was negligent. If he wasn't competent then the parents are negligent for leaving her in his care. |

It would be like driving your toddler to the side of a busy highway, taking her out of the car, letting her go and then acting SHOCKED when she toddled into oncoming traffic.
You don't put tiny children into precarious situations like that. You just don't do that. Now he's saying it happened because he's color blind??? Unreal. How does a grief stricken man come up with so many danged excuses? |

Another window angle. At very best, the grandfather is an absolute moron. Dirt, glare, tint, even a colorblind person know that the window was open. Even a blind person would feel the air and hear sound from outside. And highly convenient that video shows him going to the only open window.

+1 he thought he was being "cool grandpa" giving the child the excitement of the breeze and view -- until she used her legs to push out of his grip. Toddlers' legs are the strongest part of their bodies -- they are working on walking -- and when they have something to push off of, they can be very hard to hold on to. And it's also possible that gramps was distracted by the view or by the other people in the area or other family members looking around that deck. It's not enough to say "he has suffered from the loss of the child." If that were the case, then no one would ever cause a child's death.... and yet, they do. Remorse is not sufficient. |
