I do not understand how people do not understand the difference between the laws of our judicial system and the rules of the political system/public opinion.
Due process is a LEGAL concept that applies to people being brought into the US legal system. Trump is not on trial, even if he is brought up for impeachment and IS removed from office by the Senate he still will never have interacted meaningfully with our judicial system! Impeachment is a POLITICAL process to remove a person from a JOB. People are removed from jobs without due process all the time! You people really need to learn some civics ASAP. One process has nothing to do with the other and just because you watch Law and Order and The First 48 doesn't mean you have any idea what you're talking about when it comes to the non criminal, non judicial impeachment process created and executed by congress. |

Please explain how due process applies to the President during an impeachment. An impeachment, not a conviction. And keeping in mind that we have not reached the impeachment process and are in an inquiry/investigation stage where the best analogy to a criminal trial is the grand jury process. TIA! |
Plus, the criminal justice system actually does have a process of private investigations behind closed doors. it's called a Grand Jury. I swear, when it comes to Trump supporters, it really is hard to tell where the dishonesty ends and the stupidity begins, or vice-versa. |
If we get so far as an impeachment trial in the Senate, then the president will have counsel, will cross-examine witnesses, etc. It's true that he will have difficulty enforcing his due process rights if the Senate denies them. But I'm not extremely worried that will happen. Maybe others are. |
Yeah, but it's due process. The process that is due depends on the nature of the proceeding and the stage of the proceeding. Everybody involved in the impeachment investigation process is being given the process that they are due at this stage of the proceedings. |
The rules of the senate trial (and the house investigation for that matter) are decided upon by the Senate and the House. Once again this has literally nothing to do with our judicial system. Yes the trial run in the senate is modeled after our judicial system, but it is held to none of the same legal rigors. These rules are self imposed by the Senate. No one is EVER at risk of going to jail in an impeachment hearing (at least in the context of the impeachment hearing, it is possible that criminal charges are subsequently filed if enough evidence is presented that convinces prosecutor, but in that case the individual would immediately be subject to all the protections, and indignities, of the american criminal justice system. All of the similarities are essentially for show. None of the same legal protections and rules are in place. |
The Senate does not impeach; the House does. The Senate convicts via a trial where the POTUS will be allowed due process in so far as outlined in the rules established by the House and presided over by the Chief Justice of the SC. The POTUS has no due process rights in the House impeachment process because he is not yet on trial. That only comes later. |
