Baldoni supporter here and I don’t agree. The opinion makes clear Blake has to establish a “reasonable belief” of a hostile work environment based on a few of her allegations. They can bring in all kinds of evidence to show there can be no such reasonable belief based on her own sexually charged conduct and credibility issues.

Her lawyers may try this but Baldoni’s lawyers will argue it’s unduly prejudicial and Liman will likely agree and limit her to a summary of why she complained. It’s also a double edged sword for Lively’s team b/c if they open the door Baldoni’s team gets to indict her account and motivations.

I don't think you understand what "prejudice" means in court. You don't just get to keep out any evidence that makes your client look bad. You can keep out evidence that is highly inflammatory, might confuse the jury, or that is intended to show propensity ("this shows the defendant is the sort of person who would do what is alleged"). And the prejudicial impact of evidence is weighted against its relevance ("probative value"). But basic evidence showing, for instance, that Heath entered the makeup trailer after repeated requests not to and that he looked directly at Lively in an undressed state after agreeing to look away, will not be considered inflammatory or confusing. Heath himself admits to most of that already. Eyewitness testimony to the events that Lively believes constituted harassment would also be standard, not prejudicial.

Also, the rules about prejudice will also apply to the defense. They will be allowed to impeach Lively and her witnesses, but they will not be allowed to introduce inflammatory or confusing evidence that doesn't really go to the question of fact (whether Lively had a reasonable belief that she had been harassed). That means: no evidence about "stealing" the movie, no evidence about whether she delayed production or ran up costume costs. No evidence about the state of her friendship with Taylor Swift, about the Van Zan subpoena, etc. Most of Baldoni supporters fixate on will not be permitted to be mentioned in court and certainly won't be allowed as part of Wayfarer's defense.

You really this goes to court after all this? Liman is practically begging them to settle with this narrowed scope and it’s likely they will. Signing something where neither can run to the press snd say what went down but that everyone is relieved they can put this behind them and blah blah blah.

Lively doesn’t want another 6 weeks of content creators hashing this out plus a trial. This has veered into nightmare territory for her and it is time to let go and move on.

The statement also was not from her lawyers letterhead, which I thought was funny. I’m sure they rolled her eyes and let her put that out, but they were not going be formally associated with this nonsense.

You’ve rattled off again about the same sexual harassment points that may have been relevant prior to this week, but are no longer relevant, and youve mentioned nothing about retaliation which is one of the three claims that survived. please list all the evidence that we’ve seen that she was retaliated against.

18 months in and they have found not one content creator out of the hundreds that they went after that colluded or worked with or it was paid by Wayfarer. They also have admitted the campaign was untraceable which will be hard for a jury.

We know what Jed Wallace was paid $90,000 for. He laid out his report that he was extensively monitoring all the smearing lively’s team was going over the course of 3 months, including how they messed with Wayfares Wikipedia page- he himself said everything was traceable in his report. Something like don’t act on this, everything is traceable and we can find out who messed with the page.

It’s been almost 2 years and there’s been no evidence of collusion with any of the content creators covering this case. The incredibly damaging baby bump interview was released on a Saturday morning. They had hired Jed Wallace the Friday afternoon before. Do you really think Jed, who is a total computer nerd and sits in his basement all day, had time after signing the contract on Friday afternoon to think, I know! I will tap some international fashion journalists and see if there’s any bad interviews with Blake they want to resurface? That was obviously released organically as the journalist has admitted.

Further, there’s tons of emails from Sony execs saying she did this to herself.

When Taylor Swift was being messed with after the release of her album that people were trying to say she was a Nazi, it took people about a week or two to trace that it was a coordinated bot campaign. what is taking so long in this case?
