Daycares and covid liability waivers

I'm thinking if I was a daycare with limited spots I would weed out any applications with lawyer parents. You all are ridiculous.

No daycare - regardless of a waiver - would ever be liable for infections that are "inevitable" in the sense that they couldn't be prevented by reasonable precautions. A waiver only helps the daycare avoid liability for a situation where the infection COULD have been prevented by reasonable effort, but the daycare failed to take those reasonable steps.

It is like the people who left on cruises later in March and then later complained no one told them it was an increased risk.

Sure. Simple answer is then not to sign any waivers. It sounds like there are some places not doing this (yet).

I think the daycare world will sort out nicely amongst daycares with waivers, daycares without, parents who will sign, and parents who won't. Regardless of any of that, all daycares will have plenty of applicants to fill slots.

DP. I do understand how supply and demand works.

It's not illegal to ask people to sign. It's certainly not a problem for people to refuse and find other care.

I suspect that part of the issue is that it's not clear what "reasonable" precautions are, since advice and guidelines may change as we learn more. Even the CDC guidelines are full of fuzzy language like "to the extent possible," or "where feasible." So the line between responsible and negligent isn't a bright one. A waiver may be intended to head off lawsuits in the gray area.

Also, being sued is a cost for a business, not just losing a lawsuit. If they can head off some lawsuits with the waiver, that's a win. Given the number of people who need care v. the number of spots, even in good times, I'm sure they'll be able to fill their spots with people willing to sign the waiver.

We are applying to new daycares and two that we applied to had the waiver.

We live in America, folks. This should be expected.

This is an absolute lie. Spots are very few and in high demand because many of the schools have closed for good.

It's a shock. I am sending my DS to a few hours of camp in the morning. And it's gone from, camp is all outdoors and "very safe!" to please sign the updated waiver. The first paragraph is all bolded and says your child may be exposed to coronavirus, COVID MAY CAUSE PERMANENT INJURY OR DEATH!

It is a game changer to see in black and white and sign your name to. I totally understand!

My spouse and I are both lawyers and we signed our daycare’s waiver without batting an eye. Many lawyers are probably less fazed than the average person about signing this kind of thing; we know that agreeing to take-it-or-leave-it contracts is just part of life in modern society.
