At fault divorce..

See an attorney. No fault uncontested is still probably best.

How long were you married?

I did it in NJ. The “fault” was constructive abandonment (I think that’s what it’s called; I affirmed that I refuse to have sex with my husband). We used a mediator, the whole thing was over in 6 months, plus the 1.5 month it took to get everyone together in the same place to make it final.

OP, yes, with proof of adultery in VA the wronged party cannot be compelled to pay spousal support to the cheating party.

The issue is: will your DH agree to waive spousal support in a normal divorce? Or are you looking to get out of paying spousal with your at-fault divorce idea?

If your DH agrees to no spousal, he can just not request it at the settlement. I doubt that a judge will change it if you put an approved settlement in front of him.

If your DH insists on spousal support, then it is not an uncontested divorce.
