Depends on the state and the definition of rape in that state, as we've seen in past cases. In TN? Yes. Idaho seems to view actual intercourse, no matter how shallow, as rape, so sexual assault is about right.

It said 'edited once' so how could I be lying? I don't have edit powers. My opening post was edited 1 time at 6:37 - that was the time of the last update. I posted it at 1:03 AM. Someone edited my post, and deleted two following that first post.

There was an older kid as well, I think 12? Going from memory. There were 2 boys.

From what that nurse saw, it looks like whatever went on was not pretty and there is video. It's a shame they got evicted, however they should not have assaulted a 5 year old either. I don't know if the law favors them re: eviction. I don't see how they CAN be evicted if they are paid up on their rent?

As for the other family, I don't know what their housing situation is and what eviction law is in their area.

Again, the article in the Idahoan used the word 'rape'. The police are now stating she was not raped. The laws in Idaho define rape as penetration with a penis. So assault it is. Again, she is five years old. F-I-V-E. There is video. The boys are in custody. Something bad clearly happened to that little girl.

Regarding your post, it said it was edited because I changed the subject line which was factually incorrect.

The police never said there was a rape. A reporter used that word. Even this evening you are suggesting there was a rape. You don't even know if the assault was sexual. The police said that the older boy didn't touch the girl. The youngest boy was not detained. That leaves the 10 year old. I understand that something very inappropriate (at the least) happened between the 10 year boy and the 5 year old girl. I don't know what that was and neither do you.

Here is something else that was in the article to which you linked:

Indeed, that is what happened according to the police. I did not say Syrian. I did not say knifepoint. I did not say rape.

The Hasidic community can be pigs. Ditto some of the Amish - there was a horrendous story about an Amish family selling their 13 year old daughter to older man. He also was holding other girls. Thank God an observant neighbor turn them in.

I have indeed made comments about radical religions of all types and how radical Christians, Jews, and others are a real problem. Obama, however, is not trying to bring in people from those communities, people the FBI admits can't be vetted properly. I also believe when people say they want to kill us, they mean it. Sorting through which does and which doesn't? I don't trust the Feds to do that well - they've already failed over and over again.
