I think polygomy should be legal. It is legal in many nations in the world.

Most likely, the Supreme Court will eventually deem the ban unconstitutional, because it is. From there, it is likely that a few states out west will legalize it (Utah probably would not be the first to do so). Then it will be practiced by a few Mormons and Muslims in those states. The practice in the LDS community will be somewhat rare, and in communities that are remote or isolated in more urban areas (much like orthodox Jews). However, it could grow to be more mainstream.
I predict that some inexperienced families will try it and fail miserably. The ones who mistakenly believe it is one big orgy will get a surprise about resposibilty and jealousy. Thos practicing families work hard to make it work. The men are expected to work sun up to sun down. They hope to have each family in a separate home. Also, there are survival codes that those men know about that inexperienced men won't grasp.
The one notable example in my family took place in the 1950s. We are not FLDS, but from a non American culture. First wife became envious of second wife who was prettier and fertile. First wife never had kids. They all lived together in one house. One night, first wife killed all three children of the second wife (true story). Infanticide is a real risk in polygamy, which is not taken lightly.
The father was blamed by the other men for not isolating the families in separate homes earlier. They always warned him that he showed second wife too much favor and kissed her in front of the first wife; spousal display of affection was never encouraged in that community.

It shouldn't be.

The most compelling reason it is, is tax code and hypothetical complications with child custody in the event of a potential divorce. Neither reasons seems to me to be a compelling reason to legislate love.

This is the main reason it's still illegal and why it will probably remain illegal. This is a HUGE issue in the majority of polygamous sects in the United States and making polygamy legal is a good way to green light the guys who run those sects to take on even more brides who are young enough to be their granddaughters. I don't have a problem with polygamy between consenting adults, FTR, but I do have a problem with polygamy that involves coercion of young girls into (often incestuous) marriages with older men, polygamy in sects where child and spousal abuse run rampant, polygamy where government abuse is something to be proud of because it's all about "bleeding the beast", polygamy where young men are forced to leave the compounds because they're viewed as competition by the older men who rule with iron fists, etc. Tapestry of Polygamy and The Lost Boys of Polygamy are excellent resources for this topic.

They get away with that because they are secretive. They are secretive because they are breaking the law. BTW, it is not illegal for a monogamous man to marry a woman young enough to be his granddaughter. It is not illegal for a monogamous man to do all sorts of things to reduce completion from other men. Child abuse occurs in all families. The more secluded they are, they more they get away with it. Speak to Orthodox Jews who left and Amish people who walk away. There is a sect of Orthodox Jews in NY that receives more welfare dollars than they earn. They are bleeding the beast.

You should know that those books don't tell the whole story. If I had to write a book and I needed it to sell, I would find the most extreme situations to sensationalize my work. No one is advocating marriage to minors. That is illegal and probably always will be.

PP here. What part of the story do you think those books are leaving out? I know plenty about what goes on in the foothills of Utah, unfortunately. No one is advocating marriage to minors, but plenty of people in those states are already looking the other way when it's going on.

But none of the ills you mention are unique to polygamous marriages. It's wrong to marry minors, in a monogamous or plural marriage, it's wrong to coerce someone into marriage, monogamous or plural, it's wrong to abuse your spouse and child, however many of them you have.

PP here. What part of the story do you think those books are leaving out? I know plenty about what goes on in the foothills of Utah, unfortunately. No one is advocating marriage to minors, but plenty of people in those states are already looking the other way when it's going on.


The books are leaving out the marriages that work well and the fact that not all of the men are abusive.

No, because existing law says that freedom of association doesn't trump the states' interest in requiring a one-with-one conception of marriage.
