op here,
I dont want to be near him if we are not in public and my friends knowing and my lawyer where I am and what time. I record our entire conversation always and I save txt msg which he curses me out just because he woke up in a bad mood. I saw my son yesterday at the park and I hold my son he came and took him from my arms :.( and then he said it was enough time. I left the park crying and my son saw it and he tried to take his car seat from his dads car saying he would come to my house ![]() I have court soon and I hope I can have 50% at least of his custody. |
I'm one of the crazies. OP, has zero chance of getting her son back in her current situation. She can talk to social workers until she's blue in the face. |
Why do you say that? Is the man a better parent? |
Not this poster, but there is no documented abuse towards child, is there? So I tend to agree with this PP. |
if you are in DC area, go to Ayuda or Human Rights First, they have great lawyers who can help you for free. They helped us a few years ago, but we were in grave danger in our own country, and had lots of evidence for that. Dunno what your situation is, and not sure the fact that your son is a US citizen will help.
First go to the lawyer and get your papers fixed. Then go to social services, ask for help with work, etc. Good luck! |
There is abuuse towards the spouse, domestic violence. That does not make a person an able parent |
pp you are right..
So now, I changed my plans and i need to get my green card first and then being able to drive and work I will fight for my sons custody I just wish that the immigration process doesn't take to long. I know that up to 90 days after starting my paper work I will have permission to take my drive license and work. After that I will be able to find a job and I can have a place and prove to court that I can be a good provider. by that time I can enroll y son to a public school. I'm desperate but I need to look in a long run what it is best for me and for him. I just can't fight without my papers/job and a car. |
Domestic violence is one of the reasons you can get residence in this country. If you have witnesses or anyway to prove that you have been abused the law is by your side. The place where you asked for shelter can testify on your behalf. Call 1800 799 SAFE and they will definitely help you. Don't let that jerk continue abusing you. |
Only if you're married. |
You are brave. lots of hugs to you. My understanding is that if you were both foreigners, then you would have to leave when your visa is up. but in a disputed custody case, the custody issue has to be resolved first. Man cannot conveniently have the mother of his child deported. Find out what the law says, but according to my understanding, as long as you cannot legally take your child with you, you cannot be forced to leave |
