My understanding is that if you were both foreigners, then you would have to leave when your visa is up. but in a disputed custody case, the custody issue has to be resolved first. Man cannot conveniently have the mother of his child deported. Find out what the law says, but according to my understanding, as long as you cannot legally take your child with you, you cannot be forced to leave[/quote]
