Great legal argument. The lawsuit against Ariana has merit. The legal fees alone and the inability to sell the primary residence she shares with Tom should be enough to make her settle.

California has a very strong "revenge p#rn" laws and attorneys really don't know the outer limits of the law. Precedent cases are being set every year and the law was further strengthened/expanded in 2022.

If Ariana was showing other people explicit images/videos of Rachel without Rachel's consent (even if Rachel consented to Sandoval taking the image!), there is definitely a civil tort at play. Potentially a crime.

What Is Revenge Porn?
Revenge porn refers to the non-consensual distribution or sharing of intimate or explicit images or videos with the intent to harm, embarrass, or harass the individual depicted.

In California, revenge porn is illegal under both Penal Code Section 647(j)(4) and Civil Code Section 1708.85(a). Generally, both laws illegalize the distribution of sexually explicit images or videos of someone online, without that person’s consent, which causes that person to suffer serious emotional distress.
...
What To Do If I Am Depicted In Revenge Porn?
If you are a survivor of revenge porn in California, you have the option to seek criminal and/or civil recourse. Criminal actions involve offenses against the state, with the government acting as the prosecutor, while civil actions pertain to private disputes between individuals or entities, aiming for compensation and resolution through a plaintiff-initiated lawsuit.

Criminal action: Under California Penal Code Section 647(j)(4), revenge porn is a misdemeanor crime punishable by a fine, probation, and jail time. Reporting the incident to law enforcement is a crucial step in initiating a criminal investigation.

Civil action: From a civil standpoint, revenge porn perpetrators may be sued for violating California Civil Code Section 1708.85(a). The court may order the perpetrator to pay the survivor’s attorneys’ fees and costs under Section 1708.85(e).

It is possible to seek legal recourse both criminally and as a civil matter.

That's the point of the lawsuit - to compel the parties to provide evidence, access to text messages, etc.

Leviss's previous attorney sent emails to Bravo and the production company in early 2023 to discourage them from airing any discussion of explicit materials:
https://variety.com/2024/tv/news/scandoval-lawsuit-rachel-leviss-ex-lawyer-sex-tape-chat-1235927236/

So clearly Leviss knew that there was explicit material being discussed and/or disseminated among the VPR group.

She did. She certainly texted it. To Raquel.

Raquel never consented.

Oh, this will be fun! Love a good comeuppance.

She knew it because/after Ariana idiotically texted it to her with the words you are dead to me. Previously she had no idea the FT had been filmed by Sandoval.

What will come out is plotting by Ariana to make this into a plot line for personal enrichment (unjust).

Raquel was treated horribly. She’ll win.

If this is true, it's a lot worse than the sins committed by Stassi and Kristin Doute that got them kicked off the show.

Yes well Ariana was the original adulteress and screwed around with Tom while he as with Kristin, karma. Can't understand why everyone supports her so much, what goes around comes around.

I've never like Ariana. It's mindbogglilng to me that she keeps playing the victim when she did EXACTLY the same thing. she's a real piece of work.

+1

I am so sick of Ariana's victim mentality. I get it, Tom cheated on her with her good friend. That is awful. But it's time to move on now. Her crazy line drawing and bashing of anyone who speaks to Tom is so over the top and obnoxious. I liked it when Tom Schwartz said he doesn't like her god-like status and I totally agree.

They should do a show on the lawsuit

And pls somebody sue Seanna

It’s interesting that the two mistresses were the first to throw rocks at Raquel
