The current neighbor probably wasn't the one who planted the tree. Trees can only be moved when they're very little. If the tree predates the fence, as it probably does considering its size, it's the neighbor who put the fence who should have thought about the tree girth. Planting on property lines is habitual and not rude, PP. A section of fence costs less than cutting down a large tree, in case you were not aware. Regardless of all this, legally, the current neighbor is not obligated to pay for anything, just in case OP was wondering. |
How do you know the fence was that before the tree and/or that the fence is in the correct place or that OP’s previous owner didn’t purchase a strip of land from the current tree owner. There are lots of scenarios here |
Is there a reason you need the section of fence that the tree is growing into? Dog, Kids, pool? My suggestion would just do the cheapest thing and remove the section of fence the tree is growing into. Otherwise build the fence out around the tree. A big tree will probably cost $2K to remove. |

Most fences are not concreted or braced except corners. If this tree has interfered, your fence is likely not concreted in. If your fence is older than 2009, you just need to replace it but also talk to your neighbor about removing the tree. Ask for permission to remove it. The one thing you can’t do is blame your neighbor. Trees grow. |
