I think DOJ had an obligation before filing that brief last night to inform Trump's lawyers that they're in legal jeopardy or at the very least, material witnesses. That's why the new guy - who appears to be a good lawyer - was announced yesterday.


I’m sorry, but what? DOJ doesn’t have a team flying around the country informing people under investigation that they’re under investigation and to stop criming. Lying to the FBI in a sworn statement is a problem and you don’t need to be a lawyer for a former president to understand that.

Jury nullification is concern. All that’s needed is a single holdout. Fox and other right wing media will vilify a DC jury that might hear the case (it also could be brought to trial in Florida). And doxxing jury members is a real concern. But we are all a long way from all of this. We will have to wait and see if DOJ can flip anyone like Bobb or Corcoran and get to plea negotiations with Trump. Remember that the grand jury has been hearing testimony from WH Counsel Philbin and other senior staff. This could be the top of a bigger counterintelligence iceberg.

I wouldn't be surprised if someone at DOJ picked up the phone and gave Jim Trusty, who worked at DOJ for decades, a call. Trusty wasn't representing Trump when this all went down, and based on what he said during this TV appearance, he seems a little misinformed. "Hey, Jim, just a heads up, your guy is going need some lawyers. Soon. Try to find someone good, appellate experience would be helpful, because the facts are not on your side."

He will never plea. Never.

And you’re conflating a hung jury (possible, but would just result in a new trial) with jury nullification (acquittal despite evidence, unlikely?).

It looks really bad for them, when they certify that there was no classified documents left on the premises. Or if he put some BACK in the boxes after they searched them. That's the subpoena for documents that was served in May. There's a footnote where DOJ got permission from CJ Howell to disclose Grand Jury information.

I think we are about to see the indictment and prosecution of a former President and imminent Presidential candidate. DOJ has Trump dead to rights and should proceed, regardless of Trump's totally predictable move to declare his candidacy to try and stop the investigation.

This might really do him in with the GOP.



They already started to formally distance themselves from Trump. The problem for the Dems is that it paves the way for DiSantis, who is every bit of a narcissist and fascist.


Nothing about this is bad for Dems so far.

At least one of his lawyers has a big problem. They lied in response to a grand jury subpoena. They only way they are getting out of that is if they testify under oath that they searched all the areas the FBI searched, questioned Trump about any more documents, and that the documents must have been concealed from them.
