In your world, attorneys should be skilled in being evasive and skirting the truth; when pressed to the wall, claim no recall. Okay. That's why many people hold attorneys in low regard.

People testify "I don't recall" either when they don't actually recall or when they recognize the Yes/No questions are meant to lead the witness into saying something they don't actually know - because if they don't then they will have perjured themselves on one of the lead up questions.

+1. As anyone who has given a deposition or testified knows, your lawyer will tell you not to speculate or guess or say things you are not certain about. If you’re even slightly not sure you remember, the answer is “I don’t recall.”

The defense attorneys are the ones looking incompetent.
