Completely random late night topic for the lawyers on the boards after seeing an Obama political ad on tv. Let's just say that suddenly incontrovertible evidence is found that proves that Obama was not born in the U.S. and therefore constitutionally could not be elected President. What happens?
He's presumably removed from office, but what happens to all the laws he has signed into effect in the last four years? Are the invalidated? What are the implications for things like health care, sequestration or budgetary-decisions and so on? |
I'd suggest you follow this line of inquiry with regards to W, to see which of his policies can be reversed. I'm more inclined to believe that the guy who doesn't speak correct English was born elsewhere.

The answer to your question, OP, is "basically nothing." There would be a lot of discussion and hand-wringing, but when push came to shove, the implications of trying to undo everything that a President did in his entire term are too mind boggling. The courts would most likely say it's a nonjusticiable political question, though I can think of about a half dozen ways to say the acts are valid even if he was not technically qualified. |

The answer is that no one knows for sure, because the constitution and federal laws don't take that situation into account. So there would be lots and lots of lawyers with different opinions on what should happen, and probably a number of cases would go to the supreme court and the supreme court would rule on the question.
But Obama is an American, there is no doubt about it, so the whole issue is completely and totally moot. Signed, die hard Republican. |

I think it's an interesting question, even though I'm a liberal who thinks the birthers are gaga. But then I was a big sci-fi fan as a kid and still love these what-ifs.
I think it would result in a bunch of legal cases, at least one of which would go to the Supreme Court, which would rule that although ex post facto evidence shows that he should not have been allowed to run, he did run, was elected, and was sworn in, and was therefore the legal President of the United States. And beyond that, I think they would rule that as a practical matter, it would be impossible to figure out how to undo four years of history. |
