Your knowledge appears to be shallow - UCs were flexible with ban on use of race to UCs and strongly encouraged their readers to take a good long look at applicants from certain races even if academically lacking and not spend too much time on certain other races. They have been doing this for many years since the ban.

NP here. The point being, each school can accept whichever student they think will "fit". And that is fine. No amount of law suits will change that. We don't live in China, not all students are going to be Chinese.
