A defendant doesn’t get a new trial on appeal and doesn't get to appeal just because he didn't like the verdict.
An appeal is a chance for the defendant to raise errors that may have denied the defendant the right to a fair trial. (Or unjust sentence.) Judge Merchan has given Trump until June 13 to file for an appeal. After sentencing, on July 11, there would be 30 days to file an appeal about that. (The maximum sentence for these Felony charges is 4 years - for each of the 34 counts.) In New York, an appeal first goes to New York Appellate Court. There are 21 Justices and 5 of them are picked randomly to oversee any given case. If that appeal fails, then he can appeal to the New York Court of Appeal. In New York, a request to the Court of Appeals to reconsider a lower court decision is randomly assigned to one of the court’s 7 judges, who then unilaterally decides whether to hear the case. Some are much more likely to say yes than others. State courts have jurisdiction over state laws and federal courts have jurisdiction over federal laws. But, since federal laws include the Constitution and criminal defendants have Constitutional rights, a defendant who raises CONSTITUTIONAL ISSUES can appeal to the United States Supreme Court after state court appeals have been exhausted. The Supreme Court can't take the case because they disagree with the New York Court of Appeals interpretation of the law. There has to be some Federal violations that would grant the U.S. Supreme Court jurisdiction. |

I tried to warn people about where Republicans were headed years ago, but people didn’t want to accept what Republicans were becoming. I think it’s evident now by the fact that instead of questioning their choices in a man who is so thoroughly despicable they’re attacking the justice system. |
