Regardless of what the official sq footage is you walked into the house and could see with your own two eyes if it was too small for you.

Your agent should have told you that sq ft is often wrong on the tax assessor. We were told that our house is 1968 sq ft but the appraisal said it was less as well. However we weren't surprised because we already knew the tax assesor is sometimes off.

The tax assessor should not include the basement in the sq footage. Usually they will break it up and have a sq footage for the main floors and then one for the basement.

I don't think it's mean and nasty to note that the OP referred to the painters referring to him as "lady" -- after he is the one who says he's a male and plays the gay card (NTTAWWT) -- and then remark on a simple factual observance about what appears to be inconsistency in his relating the story.

There are three classes of real property in the District of Columbia. Class 1 is residential real property including multifamily. Class 2 is commercial and industrial real property including hotels and motels. Class 3 is vacant real property. Class 4 is vacant blighted property.

Call your mortgage agent and tell them that you just lost your job. The bank will withdraw funding, and then you can activate your financing contingency... unless you don't have one.

I just don't understand how you got this far in the process without figuring this square footage issue out.

If the space is good enough for you, just stick with it.

Here's what I don't get. You sue because you have been harmed in some way. How are you harmed? Are you out the earnest money because you pulled out of the contract? I would think since there were several others offers, the sellers will let you out of the contract but if you haven't even tried, then again, what is the harm?

Are you going through with the contract because you still want the house? If you want the house still then I'm not really certain of what harm you have suffered. You saw the house, you liked it and you want to live there. now something on paper makes you not want to live there. I think this is pre-text for buyer's remorse. let me say that I think with a purchase this big, everyone suffers from it to a degree. you need to figure out if this is really some sort of harm you are suffering because of an error on the mls, or if you just need to cope with your remorse.
