He's using more judgment than any Republican in Congress right now. He's exactly right. We should nix Trump now. |

" In Watts, supra, 394
U.S. at 706, 89 S.Ct. at 1401, the defendant was a speaker at an anti-war demonstration who said "'[i]f they ever make me carry a rifle the first man I want to get in my sights is L.B.J.'" The jury convicted the defendant of knowingly and willfully making a threat to inflict bodily harm upon the President. The Supreme Court reversed, holding that the trial court erred in denying defense counsel's motion for judgment of acquittal. The Court characterized the defendant's statement as crude "political hyperbole" and not a threat within the meaning of the statute. Watts, supra, 394 U.S. at 706, 89 S.Ct. at 1401. Likewise, in Barcley, supra, 452 F.2d at 932, the defendant mailed a letter to his court-appointed attorney, in which, after profanely criticizing the attorney for the handling of his criminal appeal, he said, "'as soon as I can get this case situated around in the position I want you are the first S.O.B. that will go, [the prosecutor] will next.'" The defendant was convicted by a jury of communicating by mail threats of personal injury. The Eighth Circuit Court of Appeals reversed, holding that the evidence was insufficient to sustain the verdict. The court concluded that the defendant's letter "is worded in the rowdydowdy argot of the streets, but it does not clearly convey a threat of injury.... [T]he government must offer something more than the equivocal language present here to establish the communication of a threat." Barcley, supra, 452 F.2d at 934. Comey is just being rowdydowdy |
In spite of your fantasies, OP, Americans have no “king”. |
He laid out the case for prosecuting her and then said "no reasonable prosecutor....." which was a lie. He was trying to split the baby. And, he was FBI, not the Attorney General. It was not his call whether or not to prosecute. FBI does not make those decisions. They just investigate. He only did it because more had come out about HRC's abuse of classified information and, maybe, he was trying to save Loretta the trouble--especially since she met with Bill on the tarmac. |
You’ll need to drum up another hoax, my friend, one that hasn’t already been tried. And failed. |
😂 |
Comey was the top law enforcement person in the country Stop making excuses for what he does/doesn't know. I'm getting tired of the teenage arguments here. |
Interesting you have no criticism for the current FBI director who decided to investigate him for clearly protected speech |
|
Usage had changed?
Sit down and shut up, ignoramus. |
|
Mrs. Comey shall be interviewed next. Wow.
Better confiscate the passports. |
Clearly protected speech? Sit down and shut up, ignoramus. |
Criticizing the president is protected whether you like it or not. Idiot. |
| Can we all agree at least that Comey is an idiot? I saw some analyst on TV that said Comey did commit a crime—he gave his enemies an opening. |
Didn't read the whole thread. It wasn't necessarily criticizing the President. But it wasn't necessarily a threat either. The Secret Service takes this type of speech very seriously and it's within their legal duty to investigate whether it was intended as a threat or not. Comey didn't do himself any favors, nor did he really endear himself to anyone. |
We can all agree the snowflakes criticizing this are idiots. |
