Technically an unwanted touching of any sort is assault. But if you think someone would normally be charged for yanking something out of someone’s hands, you are sorely mistaken. Depending on the context it might be theft, but that would be the far more likely charge, at least that would stick. |
I literally got assaulted in Bethesda Row cinema a few years back. I had internal bruising and trapped the guy in the stairwell leading out of the theater while I called the police. He admitted he tackled me and punched me multiple times in the theater. I went to the emergency room and got a report saying I had internal bruising along with medical photos. I showed up at the court hearing. The guy had a prior record in another state and still got off with nothing but community service. I think you all think assault is way worse than the MoCo law enforcement and DA think it is. It’s nothing but a slap on the wrist, seriously. I was pissed |

Possibly so, but in this case, these are kids who are probably pretty traumatized by this assault. You don't mention what led to the assault and I'm sure it was just as benign as these kids but at least you had the wherewithal to trap them and defend yourself in that way. These kids had no power against this hulking nutcase. |

I did nothing. The guy thought I somehow offended his girlfriend (he was very drunk). I don’t think they will consider “trauma” to be damage worth prosecuting |
That would technically be assault, although it isn’t entirely clear from the video that that is what occurred. But even assuming that could be proven beyond a reasonable doubt, it is not the type of assault that would normally be prosecuted and, if prosecuted, the consequences would be minimal. As another poster has recounted, even far more physical assaults that lead to actual injuries often have modest consequences. |
