If you are a lawyer, you know that OP/dc can get more than just the OOP. There is pain and suffering involved here.

I would have chased it and kicked it again. Dogs who bite should be out down. No question about it. The dog is done and should not be allowed in public ever again. I’d press charges, especially bc of the owners crappy response.

OP and her husband are the ones wanting to sue.


My husband wants to sue. I am on the fence.

My husband wants the dog owners to pay for medical expenses.

The neighbors also filed a report saying I trespassed onto the yard and kicked their dog which made the dog react and attack my toddler. This is false.


I would absolutely sue. Most likely, their homeowners insurance will settle with you. I seriously doubt that the neighbors crazy complaint that you, with two small children, walked into their yard to go kick the dog...will be entertained at ALL. You and dc were on the sidewalk, where you have a right to be, and their unrestrained agressive dog attacked your small child!

But yes, sue, you should not have to pay any expenses related to this and it is very stressful for you, dh and dc!



Insurance will pay, an attorney will take 1/3 and the woman will have her insurance cancelled. She Should pay your medical bills and apologize for her dog being loose.

We did only because the owners would not willingly give us the dogs vaccination record. The police had to visit the home in order to obtain the records and thankfully the dog was up to date on vaccines.


What kind of jackass makes the police force them to give the dog's vaccination records?


The kind who need to know whether my child needed rabies vaccines.

Police wouldn’t have been involved if the neighbors would have emailed us the records as we asked.

Treble damages for a dog bite that was treated with a trip to an urgent care clinic and an antibiotic shot? You're out of your mind.

I would leave a note for the neighbor with a copy of the bill. Let them know you were provided with ring camera footage and you will file charges if they do not reimburse you.
