I am on the fence. My husband wants the dog owners to pay for medical expenses. The neighbors also filed a report saying I trespassed onto the yard and kicked their dog which made the dog react and attack my toddler. This is false. [/quote] I would absolutely sue. Most likely, their homeowners insurance will settle with you. I seriously doubt that the neighbors crazy complaint that you, with two small children, walked into their yard to go kick the dog...will be entertained at ALL. You and dc were on the sidewalk, where you have a right to be, and their unrestrained agressive dog attacked your small child! But yes, sue, you should not have to pay any expenses related to this and it is very stressful for you, dh and dc![/quote] Insurance will pay, an attorney will take 1/3 and the woman will have her insurance cancelled. She Should pay your medical bills and apologize for her dog being loose. [/quote]
