Have they actually seen it? Maybe e-mail them a photo with a message that you are worried about damage to the house, to your own personal property, and physical damage to you. See if they respond differently once they are put on notice in writing. |

You could also contact a tenants' rights organization. In DC, at least, a tree on rental property that's in danger of falling is a pretty serious offense. We had great luck a decade ago sending our landlord a list of defects in the house that would get it condemned by the city, and told him he had 2 months to fix things before we called the housing inspector.
Of course, if you have noplace else to stay, getting the house condemned doesn't work so well. |
| we showed it to him and everything Nothing Works and im really worried the bark is coming off on the other side where its starting to rip out the ground |
| im really scared and theres another tree teaning toward my bedroom The landlord will no remove either of them but he's gonna move next to us and is going to cut those tree's down but wont cut the ones in our yard and ours might fall on both of our bedrooms. |
If you live in Virginia, if you notify him in writing - preferably with a letter delivered to him through registered mail, or an e-mail with a cc to yourself - that the tree is dangerous, then if it falls on your property and damages you or your property, he is responsible because he will be negligent for being aware of a dangerous tree but choosing not to take action to remedy the situation. Maybe send a copy of the law, too. http://hamptonroads.com/node/318391 |
| A tree fell on our house, from neighbor's yard, in Hurricane Isabel. Landed at the foot of our bed - cut through the house - and was about 8 inches from hitting my baby in her crib. The roof DID NOT stop the tree - it cut straight through the house. My DD almost was crushed to death. Don't play around with this. It can kill you. Print this message off this website and send it to your landlord. S/he cannot be wanting a wrongful death charge -- involving you or anyone else. |
| i dont know what to do anymore i have seriosly tried everything we cant afford to move or do anything about it ourselves and i dont know his email address i guess if it falls were gonna sew him and tell him he better find us another place to stay around here. |
| n i live in north carolina |
| well the tree is at the end of the house but its leaning diagnal. the other tree if it falls it will land right on my head thats y i stopped sleeping in there but the tree thats the most dangerous at the moment int rigt at the bedroom because at the end of the house besie the bedroom is a bathroom so it will hit the bathroom im not quite sure if it will go to the bedroom right now and the bad thing is the room that its leaning toward is the room that im in over half the time since the computer is in this room im so scared i dont know what eles to do |
You were very lucky that it didnt hurt you or your daughter |
| Sad. Get the landlord to fix it (you say you can't), move (you say you can't), so I guess your only remaining option is to hope it's fine - it probably has been fine for 100 years or so, so what is another 25-50 while you live out the rest of your life there --- probably will be OK. If not, part of the problem will be that you can't take charge of (care of and protect) your own life -- that's your problem, not anyone else's. |
Every jurisdiction has something called "public safety"; this is why new constructin has to be inspected every step of the way. Many are through the Police Dept., Call and see which dept. is in charge of Public Safety and have them come over and check and then go from there. Tell landlord you are going to do this and it might just scare him enough to do something. Otherwise, call a tree surgeeon and find out if the tree is rotten inside and it it is recommeded that it be cut down for safety reasons. This will cost you something but not nearly as mch as it will cost you if someone dies. |
