No doubt she has had a complicated personal life. To put it mildly. In general, if she had a civil, rather than a common law, marriage she needs a legal, civil divorce before she can enter into a civil or common law marriage with another man. Because bigamy laws But, we are talking about multiple countries, multiple states, state and federal law overlapping. I would need a timeline, a lot more info and several hours of research to figure out her tax status in 2015. Which is why even Fox is careful to say it appears she may have falsely filed tax documents. They can’t get it straightened out enough to say she did anything wrong for certain. Clearly someone looked at this. She paid them to do so If they were competent, then she is almost certainly legally okay. Otherwise, she would have amended her returns to change her filing status. Because she knows Trumps IRS would love to bust her for tax fraud. But, it is definitely complex. And you would need a lot more info on dates and places to know for certain. Unlike a Fox and OP, I can admit when I just don’t know something. I see a scenario where her filing was fine. It’s also possible it wasn’t. The info just isn’t there. I also know that marrying in ones faith tradition does not mean you want to impose that tradition on others. I got married in the Catholic Church. I’m not even raising Catholic kids, let alone trying to make Catholic sacrament of marriage the one true way. Marrying according to Muslim customs does not mean OMG! Sharia law! Separation of church and state. |
Minnesota does not recognize common law marriage. |
Common Law Marriage:
Living together doesn't automatically come with legal protections. |
Minnesota recognizes common law marriages entered into in other states. Full faith and credit. You can’t have people married in some states, and losing that status when they travel or relocate. It’s why gay marriage had to be straightened out by SCOTUS so fast. Has she always been a full time resident of MN? Was she married under the laws of another country, which is an extra special crazy twist? I don’t know the answer to that. |
No one said it did. But read the last line. Did she enter into a common law marriage outside of MN? We don’t know without more info. |
Seems as if she has lived in MN most of her adult life. Omar began her professional career as a community nutrition educator at the University of Minnesota, working in that capacity from 2006 to 2009 in the Greater Minneapolis–Saint Paul area. In 2012 she served as campaign manager for Kari Dziedzic's reelection campaign for the Minnesota State Senate. Between 2012 and 2013 she was a child nutrition outreach coordinator at the Minnesota Department of Education. |
It still doesn’t answer the question. Was there a valid common law marriage outside MN? Look, she got legal advice. Then she filed joint returns. Doing so fraudulently is a crime. She is a member of the House with a huge, Trump fueled target on her back. She could have not filed jointly or amended her joint returns, said My Bad, and paid a penalty. She didn’t. And she has been accused of many things. But stupid isn’t one of them. That makes me think she has a solid legal argument, based on a lawyers advice for a valid marriage in 2014-2015. As a lawyer, “in my faith tradition” makes me think that she— and her lawyers— believe she entered into a valid common law marriage somewhere. Also, as a lawyer, I would be interested in knowing what the specific basis of that argument is. Because now I’m intrigued. We just don’t know. But as a human being and American citizen, one member of the House’s martial status as it pertains to tax filings for one year is pretty low on my list of things to GAF about. Her district can make a decision in whether to keep her next year. I think it’s great any time more voices from. More communities are represented in Congress. I’m glad we have a couple Muslim members. And a Native American member. And more women in the House than ever. And an out bisexual Senator. I don’t think they are an existential threat to the American way of life. I don’t know a lot about Omar. I don’t have strong feeling about her specifically either way, although from what I has seen she should “use her anger wisely” as a friend says, and not be so quick to bite. If she broke the law, she needs to resign. I really don’t have an agenda here. I just doubt she did anything illegal with her taxes , because I am skeptical of Fox News “scandals” involving Trump’s “enemies”. And more to the point, because it appears she filed her taxes after getting legal advice. |
So, I guess you agree that she should answer questions about this conflict? You agree that she should answer how she filed a joint return with one man when it appears she was legally married to another? |
Absolutely. I think anyone who holds federal office must, at a minimum, follow federal law. And that the people in her District deserve to know if there was tax fraud. If there was, Pelosi should pressure her to resign. You clean your own house first. But my educated guess is all smoke no fire. But if she were my Congressperson, I would want an answer before I voted in 2020. And I would consider any tax fraud disqualifying. |
Thank you. That is really all I am asking for. It appears, to me at least, that she was legally married to one man (divorced in 2017) while filing joint tax returns with another. Whatever she considers her status with this other man is immaterial if she was legally married to a different man. |
I would like to see a Snopes on the timeline, which is a mess. Because I agree. If she had a valid civil marriage to someone else and no divorce in 2015, I don’t see how you get to a common law marriage and legal joint filing status. But it is not at all clear to me from the timeline WTF her status was at any point 2010-2017 and I think there is probably more going on legally that just “still married in 2015”. I’d like to see a neutral, fact based Snopes type time line and explanation. And maybe she really is dumb enough to file a fraudulent tax return while a candidate for federal office. If so, bye bye. Now, can we also, agree that if Trump committed tax fraud, he needs to go? Because hypocrisy. |
+1. Simple question |
Explanation given. It’s entirely possible given the way marriage law works she was legally married. It’s also possible she wasn’t. You don’t know. I don’t know. And Fox News doesn’t know. She does need to provide an explanation. |
Fact: She was legally married to one man while filing joint return with another.
Fact: She claims she was divorced "in her faith tradition." Fact: She was married to another "in her faith tradition." Fact: We are a nation of laws. She was either fraudulently filing a return or is a bigamist. |
We need more bigamists in office. |
