School not following IEP

You can call for a Periodic Review of the IEP at any time.
At the IEP meeting, take copious notes.
Ask for documentation of progress towards the goals. If you can't see it, then it did not occur.
I hope this helps.

My advocate did not notice that the IEP was not being followed either and based on observation without supports/services thought a private placement at a SN school maybe a better option.

Would you keep an expert who did not catch an error like this?

Yes, planning on it.

Don't just call. Write an email documenting the non-compliance provide the IEP, etc., and ask the school district's compliance person to get back to you with a time for a phone or in person appointment to discuss solutions. You need to make a paper trail. Then, after the phone call follow up again by email with a "thank you" that documents what you understand to have been discussed and the promised actions.

OP. Not just calling. Will fill out the forms to have it on the record with the proper authorities.

If so, chances are that your child will not receive much help beyond extra time/quiet place to take his tests.
We were in public for a year and a half then went to 2 HRCS. Two months into the year, we met and wrote the IEP goals, and even though the school assured us that everything was being followed, my child said again and again it was not true at all.
We have been at our current charter for over 2 years, met with the IEP coordinator a month after enrollment, rewrote the goals; yet again, the only thing which is being followed is allocating extra time for tests (not quizzes) in a quiet room with no distractions.
From what I hear from friends /neighbors, regular DCPS schools are much better in following IEP goals.

Op. I am filing a complaint with OSSE for refusing FAPE. The school is setting kids like mine up for failure: There is no way my child's IEP goals can be met since the school is not providing the needed specialized instruction.

Hey OP, good luck. This sucks. I suspect we are at the same school...have you contacted the head of school since she is a constant in a changing administration, and would likely want to make sure her new team is doing everything right?

Thanks! People should check to make sure their kid is getting the correct services and that the sp Ed team READS the IEP. Grossly negligent on their part.

I did inform the head of school: Have to send a copy of the complaint to the school when filing with OSSE.

Did the observation show that the IEP was not being implemented? If so, then the advocate did catch it.

Had more than one expert. We are no longer working with the expert who did not catch that the IEP was not being followed and took the school at their word.

OP, are they unwilling to go back to providing the supports they were giving your kid in previous years??

OP. it's not that the school is unwilling to give the supports that the school has been providing since prek, the new Sp Ed team at the school, simply had not read the IEP and provided the wrong service not specified in the IEP.

I believe it was simply a honest, INCOMPETANT mistake.

Now they are doing a lot of "covering their ass" instead of admitting they had not fully read the IEP.
