You are wrong. Just wrong. OP said there is no custody in play so guess what?code for He has no established legal right to the kid. The 6 months can be waived. So SC Troll. "How you doin'?" |
Custody can go from not being in play to being in play. At the very least OP should go down to the DC Superior Court's Self Help Clinic to get the lay of the land. |
I'm not a troll. I'm a single Mom that wanted to relocate home and cannot. If you relocate you can file in DC. If you file or move to DC he can file in home state. Home state will take jurisdiction if this happens <6 months. If he files an emergency motion in home state he can compel her to return the child to home state so he can see the child. It then becomes an incredible mess. She has to hire two family attorneys in DC and home state. DO NOT move without his explicit permission. |
Ok. Sorry this is incorrect. He has no legal right to the child right now. Please unless you know the law don't present your personal experience as the end all to be all. |
Is that because a court has already affirmatively found that he has no right to legal or physical custody, or because the issue has never been in court? Because you're about to file asking for child support, which presumably will be based on the fact that he's the child's father. As the father, he may very well have a legal right to the child, and he might very well assert it--custody may not be in play now, but that can change. I highly recommend consulting a family law attorney. |
Your question has made an assumption. Guess again. If you wNt to play lawyer get smarter. If you are a lawyer think harder.signed OP |
Can you show me where it says Fathers have no legal right to the child? He has a legal right to see his child and can file in court to have them uphold those rights. I've paid at least 3K in fees for a well-researched opinion on the subject. |
goodness.
no one calling out the unfair demand of more child support because she made a decision to move to a higher expense area? if you didn't get enough CS to move here, DONT MOVE HERE |
No there are instances where a legal right has to be established. This is one of those instances. Sorry your brain cant understand |
Hmm. He hasnt paid support. Duh! |
And FYI he will be paying lease per month than had I field in my last state. |
**filed |
i stand corrected! |
The only instance is if he is not on the birth certificate. Is that the case? If so then you can't automatically get child support without going to court either. Are you the OP? I'm trying to help you avoid an incredibly costly, multi-state custody and support battle. |
Thanks. My question was only when can I file in DC. Today or in June. I can file today. Thanks everybody for your help. |
