You must wait 6 months to file in order to get jurisdiction in DC. As soon as you move, however he can file for custody in your home state and use for the child to be returned.
You are wrong. Just wrong. OP said there is no custody in play so guess what?code for He has no established legal right to the kid. The 6 months can be waived. So SC Troll. "How you doin'?"
I'm not a troll. I'm a single Mom that wanted to relocate home and cannot. If you relocate you can file in DC. If you file or move to DC he can file in home state. Home state will take jurisdiction if this happens <6 months. If he files an emergency motion in home state he can compel her to return the child to home state so he can see the child. It then becomes an incredible mess. She has to hire two family attorneys in DC and home state. DO NOT move without his explicit permission.
Ok. Sorry this is incorrect. He has no legal right to the child right now. Please unless you know the law don't present your personal experience as the end all to be all.
Can you show me where it says Fathers have no legal right to the child? He has a legal right to see his child and can file in court to have them uphold those rights. I've paid at least 3K in fees for a well-researched opinion on the subject.
