I think I need to speak with a Labor Lawyer

Awful. Bully bosses are the worst, they leave a wake of turnover and hr or higher mgmt never do a thing.
Try speaking to ethics director? They are different than hr. more confidential.

OP, four and five months maternity leave is really, really, rare. Especially after working less than a year. You do recognize that, don't you?
Anonymous
OP, that is a lot of leave, especially during busy season.

I get 6 weeks paid at my small company and have to use all my vacation and sick days first. Even 3 months is very generous. Don't get greedy.

OP again. I"ve been here for a decade, not less than a year. I was telling you that two other women got 4 mo paid and both of them were here less than a year.

I"m not greedy. I'm underpaid for my position and I've earned it. Also, in my field, 4-6 is pretty standard for people at my level.

Anyway, we had another talk and he is being a passive aggressive bully. I must now just deal.

Being a passive aggressive bully is not against the law.

Were the other women a different race, religion, or other protected category, than you?

Does it say in your employment handbook that you are entitled to 4/5 months maternity leave?

I'm not understanding why you feel your legal rights have been violated.

FMLA is 12 weeks and includes all your unpaid/sick/vac time throughout the 12-month period pertaining to the leave. OTOH, if your company give people 4 months off that could work in your favor, as companies may be more generous than FMLA allows but are also supposed to be 'consistent' about applying their policies to all. I've had to take a bunch of FMLA classes as a manager in the past and the attorneys/HR always mentioned that everyone must be given the same amount of time, it must be tracked the same way, etc. That you can't give one person 4 months another 3 for example. Best of luck OP.

OP said the firm has less than 10 employees. They are not subject to FMLA.
