You have no idea what "censorship" is obviously. No one is telling the government to censor rush. A private citizen that files a defamation suit is simply holding another private citizen accountable for the damage his/her defamation has caused. You are free to say what you want, that doesn't mean you aren't responsible for what you say.

It will all boil down to damages. Of course, she doesn't really have $$ damages because she's a student. Youmight think that because she's a student at a top law school her earnings will be huge and they probably will be--but they aren't yet so--anything that you would guess will be speculative at best. On the other hand, you could say her earning potential has been enhanced by the scandal, but again--speculative. At best, you have a 50-50 chance of winning the case. It will settle for @1mil. Rush will go on like Satan himself, barely having missed a beat. But that million will sting him at least. He might decide to reform for a while and get clean. That's when we can expect him to fall off his stupid wagon and OD on oxy.

The man makes 56mil+ a year. I bet he will spend the 1 million in taking her to court rather than settle.
