Well he bought himself a presidency for 250$mn. Quite the bargain. Especially since he can embed his companies into the USG for billions of dollars in contracts and reduce his tax burden by even more...

Congress passes legislation. The President signs it into law. The courts decide if it's constitutional. It's that last bit that's important here.

You take the good with the bad. Write better laws and the courts won't get involved.
