It's been removed from the Department of State website and there are various articles about it. I think if someone has X that it would be wise to get that updated so they don't have re-entry issues.


What about people from other countries with X? You can't legislate people out of existence. Trans people are real people.

I am a republican and my perspective is go live your life. If you are kind and welcoming most people with respond in kind. If I accidentally misgender you please go on about your day without making it a huge issue. There are a lot of letters and moving parts to the LGBTQA+ and it is quite fluid and confusing.

Trans people are having passports reverted back to their original pre-transition sex. In some cases there have been reports of refusal to issue a passport to trans people at all. Some are worried that Republicans are trying to trap people in the US for some unknown reason.

Okay, so you are talking about kindness and tacitly complaining about your feelings when/if you misgender someone.

But this isn't a conversation about feelings. It's a conversation about how executive orders and legislation are being used to make the lives of transgender Americans exponentially harder or near impossible.

So far, that means:

* Ending access to gender affirming medication for even legal adults (18 year olds)
* Banning trans folks from the US military and discharging those that are currently serving
* Refusing to issue updated documents, including passports. This means that hundreds of trans folks are currently without documentation, with the numbers obviously growing by the day
* Instructing the DoJ to bar transgender individuals from facilities such as shelters for those who have experienced intimate partner violence
* Dropping all Equal Employment and Civil Rights investigations that were filed on the basis of gender identity

Advocacy organizations have confirmed that passports are simply being held without processing for now. So, if your passport was in the system when this began, you just aren't getting your materials back.

So far it seems like they’re leaving current passport holders alone because they don’t want to deal with additional work (and of course they aren’t allowed to hire staff). But if your passport expires during Trump’s term in office, they will issue the next passport with the old marker regardless of what any of your other identification says and even if you had bottom surgery.

+1 This is not just an issue of identity - it presents a very real safety concern for transgender individuals inside and outside the US. If your gender presentation (the way you look) doesn't match your passport gender marker, it can create a lot of issues.

For some trans individuals in states that did not allow people to update gender markers on other state-issued IDs, a passport is also the only form of identification that matches their gender presentation. So the US government is holding peoples' only valid identification hostage.

Why not just add a gender designation on the passport for people who need it. So in theory we would have your sex and then a gender designation if necessary.

This has been underreported:

It is now the official policy of the U.S. government to cruelly "out" trans adults -- even if they have lived decades as male or female with all of their paperwork updated and consistent with their gender.

Specifically, passport examiners processing renewals at the U.S. State Department have been instructed to go back in the State Dept's records and look at the first passport issued for each person. If they find an old passport with a different gender, they will proactively make a change on the trans person's behalf and list the old gender on the newly-issued renewed passport.

Explained more simply: When Chaz Bono and Laverne Cox next go to renew their passports, Chaz will receive one that says F, and Laverne will receive one that says M.

Of course, those celebrities are out and proud. We all know they are trans. But think about all the other trans people, who transitioned decades ago and are just going about their lives, minding their business:

-- Under this policy, they will be "outed" as trans every time they cross a border.
-- Under this policy, they will be "outed" as trans when their employer asks for a copy of their passport for work travel arrangements.
-- Under this policy, they will be questioned why the gender on their passport doesn't match their drivers license or travel documents.
-- Under this policy, they won't be able to travel for work to certain countries, if being trans is not safe in the country they are being asked to travel to for work.

The ACLU has already filed a lawsuit challenging this practice, there will be a hearing on the case on March 14.

Yesterday, a bill was introduced in Texas that would make it a state felony, punishable by jail, to be transgender. See Texas H.B. 3817

Sec. 32.515. GENDER IDENTITY FRAUD.

(a) A person commits an offense if the person knowingly makes a false or misleading verbal or written statement to a governmental entity or the person's employer by identifying the person's biological sex as the opposite of the biological sex assigned to the person at birth.

(b) An offense under this section is a state jail felony.



Before everyone says this is oh, this is just Texas being Texas and is unlikely to pass - please note that our federal government is also moving in this direction, claiming in at least one instance that trans people, merely by virtue of being trans, are committing fraud. On Feb 24, the U.S. State Department sent a bulletin directing border officials to permanently bar trans athletes from entering the U.S. The clause being cited by the federal gov't is Section 212(a)(6)(C)(i) of the Immigration and Nationality Act: "Any alien who, by fraud or willfully misrepresenting a material fact, seeks to procure (or has sought to procure or has procured) a visa, other documentation, or admission into the United States or other benefit provided under this chapter is inadmissible."

Passports specifically ask for sex, not gender. Nobody can change their sex. Gender, I agree, is something different. But that's not what's being asked.
