Perhaps but Biden administration is only perpetuating the policies of the Trump administration despite the babbling otherwise from Trump. Both administrations have been woefully negligent on the problem and I agree it’s frustrating. Ironically, the Obama administration was the toughest on immigration of all of the recent administrations but racist MAGA’s refused to ever accept that. And no, I’m not a Democrat for what that’s worth.

There are legal proceedings, but after the proceedings the person is still in the country illegally and should be handed over to ICE.
