You did not answer this in the other thread. It's the most important question of all. Without that piece, nothing will work. The child risks deportation and never being allowed to step foot in the US ever again.



The US has let over a million people, mostly military aged young men NOT from our neighboring countries and many from hostile countries an ocean away cross into our country illegally, with no visa and none of the documents citizens must present if they are flying into the country.

Most of these people were just released into the country.

Based on this it is laughable to think the the govt is going to care about some kid cheating on their visa or overstaying their visa to go to school in a sanctuary county like Fairfax County.

If she comes on a tourist visa she will break the visa conditions by going to school. She will have problems trying to get a new tourist visa. They will ask her if she went to school while here and then what? Lying to a visa officer?

Otherwise she is fine. Kids who are here illegally have nothing to lose by way of visas so that’s why they enroll in schools. Of someone wants to be in good immigration standing it’s a different story

Haven’t you heard about upstanding citizens being punished for things homeless people get away with?

Absolutely. It is super easy. Don't show her passport as a form of ID. Make sure she brings a birth certificate and decline to state her immigration status. They can't make you show any immigration information. Say she was sent to you and you are her guardian. She has no parents in the country and of course they will enroll her. How do you think the half a million migrant unaccompanied children have arrived in this country in the past five years have enrolled in school around the country. You just need to make sure your cousin doesn't say she came on a visa. She just needs to say she doesn't want to talk about it. Explain there are family issues and no one else can take care of her.

My cousin ( Canadian citizen) came here as foreign student but attended private elementary/ middle school instead of public school, as there were some restrictions like length of time she’s allowed at fcps etc. Just check with school first like others suggested.

I'm sure there are undocumented children in public schools. But here, the parents don't live in the district. OP isn't a legal guardian. That's a different set of hurdles.

This is very important. People are deported from the US all the time, and people who have done much less wrong than overstay for school, have been barred for life from the US. Just because the media tells you that undocumented kids are living high off the hog in your county, doesn't mean people with the means to do otherwise can just show up. They can't.

I overstayed two times. Nobody asked about going to school or not. They even gave me visa second time and then green card.
That said, they may ask, and also, I do not recommend anyone overstaying their visas and complicating their life.
See if the child can be a exchange student. Or sponsor them to become a college student here once they are old enough.

No, the child is not a US citizen.

This is not about the child’s nationality or immigration status. This is about the parent not being present. OP has no standing as she is not the parent or legal guardian. And there’s no “legitimate” reason for the child to be with her. There’s no family tragedy or incarceration.

Are you fair skinned and blue eyed?
