FCPS Denying ESY Due to Staffing?

My child has received ESY for several years. She has significant learning and physical needs and suffers severe regression without ESY. In the IEP meeting, the PSL said that they were basing their decision on my child's progress this quarter towards her annual goals.

We are working with an advocate and I understand that we could do a "stay-put" to keep ESY from the last signed IEP. However, I am curious as to if other families that traditionally get ESY are being discouraged or denied ESY. It makes sense that FCPS might try to do this in an attempt to address the ESY staffing problems, but maybe I am missing something.

Not trying to start a debate about hiring for ESY. I know it's a hard job and that the teachers should be paid more! I also know the quality of FCPS ESY leaves much to be desired.

I’m in the same boat. I got an email that there isn’t enough staffing, and that I would receive updates June 6 and June 15. I think at this point, it’s safe to say they will not have enough teachers. They need to come up with alternatives to meet the service requirement. I’ve been studying the Virginia DOE resource document, and recommend you do the same.

DS had ESY in 2020 and 2021 but was denied it in an IEP meeting this week. We are appealing.

No mention of staffing as one of the reasons.

Uh…your child could have it 5 years in a row and no longer qualify if they are not on the cusp or making a skill and there was no regression that wasn’t recouped. Did your school not explain the reason?

I’ll never get why IEP teams don’t explain. Every district has a criteria, as all kids are not entitled to ESY.

+1 IEP Law is federal, you have rights beyond what the school wants you to think. Get the lawyer if you’re ever denied services.

Yes, they should march teachers into the classrooms at gunpoint for your precious, precious bebe.

Neat. That will require teachers. Please send them your suggestions.

We're at the last week of school. I recommend you contact your PSL (Procedural Support Liaison). If you don't know who that is, you can find it here:

https://www.fcps.edu/academics/academic-overview/special-education-instruction/special-education-procedural-support-1

At this point, I don't know how they plan to fill those positions. It's time to think about alternatives such as private tutoring. Ask the PSL what other alternatives there are for providing FAPE.

They are supposed to send an email update today. Maybe wait for that before you reach out to the PSL.

Montgomery is also struggling to fill teachers. They sent a desperate email stating that any special ed teachers who take a job would get a 25% increase in hourly rate for the summer. Hopefully, Fairfax is doing the same and is getting some more teachers.

Its actually good news that they can't staff ESY. ESY Is useless and you can use the lack of staffing to get reimbursemnt for private services.

Any ESY updates?

They raised the IA pay to $27.08 per hour as of today. Staffing for Foundations is the priority. A lot of IAs will work Community A or Community B but won't do Foundations.

They have not hired any additional teachers or IAs since June 7th.

When will parents be notified?

Next update is June 15. I think it's safe to say at this point, those who don't receive placement should receive private services. Contact your PSL to ask how they will pay for that.
