Rape Victim: Hilary put me through Hell

Anonymous
Anybody who thinks rape victims of any age are going to do well under a Trump presidency is delusional. This is a man who raped his wife and wants to screw his own kid.

If you can't imagine a situation where, in 1975, a young female attorney from Chicago by way of Wellesley and Yale felt she needed to adopt a certain mode of dress, behavior, and speaking in order to effectively conduct business in a judicial system dominated by older men in a small southern city (town), then you clearly haven't the foggiest fucking notion of what life used to be like for women, especially in certain areas if the country and in certain lines of work.

Not the "foggiest fucking notion"? I'm not PP, and I don't care much about the accent. (I think most all politicians are performers by nature.) But come on. Not everything is necessarily the result of sexism and not everyone who disagrees with you is a horrible sexist.

I was born in the 80s, but unlike you, I have read about women's experiences in the decades before I was born. Get a clue.

LOL. I'm older than you. I'm a lawyer. And I'm a woman. Consider the possibility that I'm not the one who needs to get a clue.

Lololol. You READ about it? Well, that must mean you are an expert. Did you read it on the internet?

ETa: apparently I can't read. I was actually agreeing with the scenario of a young woman an attorney in the 70s having to adapt to a patriarchy. I thought PP read about how that was not accurate. I need to have coffee before I get on here

He explained that essay. It was a critique of gender roles and he admits it was horribly written. When you take the quote out of context, it looks bad but the statement itself was not bad. You are comparing apples and oranges. Hillary destroyed that little girl. Make of it what you will but she is no feminist.

Feminism has changed a lot since 1975.

There are no gray areas here. A 12 year-old rape victim is not fair game for any decent human being.

Our view of rape, and rape laws, have also changed a lot since 1975.

Oh, dear Lord.
If the thought of protecting a 12-year-old who was brutally raped has changed since 1975, then we must have been a terribly callous nation in ’75.
I was a young adult then. It has NOT changed that dramatically.
In 1975, the rape of a 12-year-old was outrageous and unacceptable. Period.

Then, as now, the rapist is entitled to a defense attorney, and the defense attorney is supposed to represent him, not the victim. The victim has her own attorney, who represents her.
The state prosecutor represented the victim. It appears that the prosecutor did a shitty job, and you are blaming Clinton for doing a good job.

Sorry but in my world there is no excuse for a so-called "feminist" to destroy a 12 year old child who has been raped.

And then 30-some years later expect that same little girl to believe you when you say things like "All victims deserve to be believed" and tell her vote for you

I guess you are so dogmatic and unchanging that you have never reconsidered any of your thoughts and beliefs and made mental adjustments in 30 years. Darn, it must be sad to be you. Unclench.

It was for her comments and her behavior.

Apparently for her behavior as a defense attorney and her comments in the 1980s, when describing the trial.

Yes, it it the 1980's interview that is the most damning. Listen to it. Disturbing that she can be so glib.
I have no quarrel with her defending her client.

+1 Her tone of voice really freaked me out. She is talking about a child's blood on his underwear and laughing.

Clinton ...wrote that Washington County prosecutor Mahlon Gibson "called to tell me an indigent prisoner accused of raping a twelve-year-old girl wanted a woman lawyer. Gibson had recommended that the criminal court judge, Maupin Cummings, appoint me. I told Mahlon I really don’t feel comfortable taking on such a client, but Mahlon gently reminded me that I couldn’t very well refuse the judge’s request."

...In 2008, Gibson told Newsday that "Hillary told me she didn’t want to take that case. She made that very clear."

According to Gibson, Clinton called him and said, "I don't want to represent this guy. I just can't stand this. I don't want to get involved. Can you get me off?"

"I told her, ‘Well, contact the judge and see what he says about it,’ but I also said, ‘Don't jump on him and make him mad,’ " Gibson said. "She contacted the judge, and the judge didn't remove her, and she stayed on the case."

Feminists were already trying to fight those horrific smear tactics that were used in court to destroy and discredit rape victims. I am sorry but Hillary Clinton is not a good person. Regardless of the law at the time, she did not behave like a human being with a heart.

Let's go back in time 40 years and tell Hillary not to defend her client to the standards practiced in the court.

You know, if you really think this was okay, then you are a pretty crappy person. I hope you don't believe that. Really, it is best to keep quiet about this because you are only making her look worse.

DP, Are you a criminal defense attorney? Did you study criminal defense in law school? Do you understand what the term ineffective assistance of counsel mean? Do you know what bar suspension or debarment means. She had a duty to give her client the most vigorous defense possible using the laws, rules, and strategies available at the time. During that period of time in our legal history, every criminal defense attorney would and did use the same tactics. So ladies, are you holding Hilary to a higher bar because she is a woman.

Can a lawyer tell me if it is the norm, in cases of child rape, for an attorney to make claims about the character of a child possibly enticing an older man to rape her? The affidavit claims that this little girl is emotionally unstable and she seeks out older men and also makes false claims about them. The child is 12 years old. I know this happens with adult victims but is it necessary when the rape victim is a child?

Yes, we do. We laugh and celebrate our victories when we get them.

I just listened to that entire recording. Clinton was able to get the case plea bargained because the State mishandled the evidence. Based on what is on the tape, the State threw away the evidence. I'm obviously not a lawyer, but I think Clinton herself would be subject to malpractice charges if she hadn't pursued that in defense of her client.

That is a different point. I am not criticizing a defense attorney for doing her job. It is her skewering of the young girl and her gleeful remarks. This is the antithesis of feminism.

You keep saying this, but have yet to provide any proof of these gleeful remarks. Make up crap, much PP.

+1000. People on here seem to have a gross misunderstanding of what criminal defense attorneys do. Even if Clinton actually knew her client was guilty, she still had a duty to zealously represent him.

People understand that. They also understand that, if in Hillary's shoes, they would rather quit than destroy a 12 year old rape victim.

I guess you're no trial lawyer.

Sounds more like she was a lawyer who had a legal duty to defend her client, one who was assigned to her through her firm's pro bono agreement, not one she sought out.

are you surprised Hillary drags out her Southern drawl when it's convenient? She does it quite frequently.

Oh please. Of all the reasons to attack her. I slip into it too if I'm speaking with people from the south. It happens organically. Get over it.

So do I. It's kind of funny to my friends because I can pick up a southern drawl, NY twang, or Pittsburgh accent, etc. in no time flat. I guess when you travel and move around a lot it happens. Or, maybe I am just more attentive when listening to others and just fall in smoothly with my surroundings.
