What happens when a child injures an adult?

WTF. If you know you injured someone, you do the right thing and take responsibility for it. OP is not off base, at all.

I was injured in ES in the 70s on the playground because of some stupid thing another kid did and the other family paid for our medical expenses because it’s the decent thing to do. Who raised you people.

100%. i’m not sure why all these people think the family of the kid who dropped the water bottle is just free from responsibility here. That’s not how this works.

No. this is why you have health insurance.

Most people have co-pays and deductibles. It’s easy to spend $400-500+ at the ER when you are getting a CT SCAN and/or MRI. Most insurance policies don’t have a $0 ER copay. Why does OP need to pick up the bill when concussions are brain injuries and serious and she has to live with that. Even mild concussions have short and long term health implications, and OP’s concussion was moderate.

Exactly for many many people even with health insurance this could actually cost thousands not to mention time out of work.

Thousands for a mild concussion!!!!!!! I'm glad the child's mother didn't provide her information. You sound insane.

If someone backs into your car today and you get a concussion or your car gets damaged, I hope they drive away because accidents happen. You’ll live, you may live differently, but it’s not there problem! Great attitude. Hope you live it either by choice or by karma.

That’s what car insurance is for and that’s why we are all required by law to carry it. The same with medical. Comparing this to a car accident is exactly why you’re getting the reaction you’re getting. Those things are not the same and the whole analogy is ridiculous. It’s like comparing a paper cut to a stabbing.

nobody is required to carry health insurance. That’s why many don’t have it.

Uhm, yes you are. But either way, OP has health insurance which is the only course of action she needs to take.

No-they are not. some people make too much to qualify for medicaid and make too little to afford health insurance. it’s not a requirement. I didn’t have health insurance for about 5 years. it’s not illegal to live without health insurance.

OP how did you get home? Surely you didn’t drive your kids home if so badly injured?

Yes, and considering it was someone’s child’s negligent actions that caused the injury, that family should OP. And ER visit isn’t pennies. If your kid damages someone’s property or injures someone, of course you are responsible. I cannot believe some of these responses.

My goodness. Accidents happen. Most of us wouldn't have gone to the ER for something like this. What do you expect the family to do? Pay OPs wages for a few weeks? JFC

On the forms it asks how an accident happened so your health insurance can seek payment from the responsible party. You do realize that health insurance pays with real money, your money.

I feel like the parent of the bottle kid is here.

I mean, what are you going to do with the information? It was a kid, not an adult.

In general the law doesn't recognize criminal culpability in very young children.

Are you just upset because the kid's parent is clearly anti-social on some level? I mean I get that, I do. They should have apologized profusely and been very concerned with your well being.

But that said, if it was a young child I'm not sure what else you'd expect?

The children were 2 and 6/7. The parent said the two year old dropped the water bottle on my head, but I have no idea how the two year old who was under 3 feet would have dropped the bottle over a 4 foot bar, so I thought it was the 6/7 year old.

I don’t know what I expected. I was in shock and kept thinking about what would have happened had it dropped on my 3 year old. From a damages issue, I had a friend who had to not look at screens for 20 days with a concussion and another friend who was put on leave by his hedge fund after getting a concussion because he lost so much money. I was thinking ‘what if i can’t work and make money’ and ‘what if i have a brain bleed and die’.

And yet, here you are, posting on DCUM...

If you had the other person's contact info what would you do with it considering where you are now?

Yes, I have a moderate cervical concussion. I went to the ER because I had a horrible headache and my neck hurt and I wanted to rule out something like a brain bleed.

I wouldn’t do anything knowing what I know right now about my condition. If I had a brain bleed and my life was transformed I would tell my spouse to get in touch with a friend who is a lawyer who could advise further. I make half of our HHI and a prolonged period away from work would not be good for my career or our finances. My spouse would also be smart enough to google the people and ensure we don’t hang any entanglements.

I asked here primarily because I wanted to know if there was some etiquette you were supposed to follow. And if it had been my child I would have said yes, but I also would have asked if the person was ok.

So, think this through - if that happened to you you would truly want the parents of the child who accidentally dropped a water bottle to finance the rest of your life? I mean, stuff happens.

How on earth did your cervix become involved in this incident?!

OP-I would ask the facility if they have video inside and ask for the footage. i’m willing to bet it was the older child and it was thrown or dropped on purpose.

And I would get a lawyer and have them be the ones to ask for the video so they are less likely to be jerks about it. And they will also be 100% able to provide you with the information for the family as long as you have a legal reason (hence the lawyer). I’m sure the other family registered to be there/signed in somewhere/etc. At the very least they should have outside security video that would show them arriving/leaving in their car with license plate.

And all you posters claiming “it was an accident, calm down” etc…This lady sustained a head injury. A head injury is serious regardless and you are all crazy to think this is ok.
