How aggressive is Virginia?

I'm from Virginia and was claimed as a dependent by parents as well as paid taxes on income from 2021-24 while in college. Spring of 2025 (Jan to May), I was in college. This semester I had a job with the University that fully covered my tuition. I also had another remote job during this time. Both jobs used my local address (at the university) and paid taxes in that state (Midwest; No reciprocal taxation deal with VA). May through July, I was in VA (no job/no income) but moved to another state in August for work - in the South, no reciprocal tax deal with VA. Since I don't have a car, didn't bother changing my driver's license to that state (continues to be in VA).

If I pay taxes in my college state for the first half of the year and taxes in my current state for my job in 2025, am I good? Both will be as part-year resident. Do I have to file taxes in VA at all? I've gotten input that I should also file a part year resident tax in VA but since I didn't make any money in VA, I'm not sure it makes sense.. Assuming I'm wrong, how will VA know about this and how likely are they to come after me later? Income for first few months was about $35K.

I would recommend that you see a tax place like H&R Block. They know all the information you’re looking for and it doesn’t cost much for peace of mind.

Virginia will come after you (I moved out of VA in January 2012, and then they sent me a letter in 2013 asking why I didn’t file my taxes for 2012 - I sent a copy of my lease showing my new residence and they dropped it). Just be prepared to show that you were not employed in VA during 2025 and relocated.

I'm a business owner in Virginia they are aggressive and relatively quick to follow up.

I would not call this “coming after you.” They asked a question in a letter, you provided documentation of a lease and they dropped it.

You need to determine what is your legal domicile. That is where you pay taxes. It’s probably your home state, where your parents live and are claiming you.
You need to file in your home state, and you need to file with Virginia with proof of other state and get the money back from Virginia.

I am assuming your parents are not claiming you for 2025 because they did not pay at least 50% of your support, correct?

Ok this is why he needs a tax person. They will ask him to fill out a form asking him relevant questions based on his needs.

Virginia is pretty assertive about domicile. There are specific facts that determine domicile. One really wants expert advice.

OP really ought to talk with a CPA or tax-attorney.

Did your parents claim you as a dependent for 2025?

Are you registered to vote anywhere (or were you earlier in the year?)

And update your driver's license!

We've dealt with situations of mid year job changes, relocations, etc. In your case, (if it were me), I would file as a part year Virginia resident through July (with income sourced from other states). You were a student (temporary presence in your university state), you moved back to VA presumably with you parents for part of the summer. Virginia would likely view it that you did not change domicile through July.

I would file as a part year resident of your new state starting in August. That sounds like a job change and a real move. I would change your driver's license immediately and register to vote in your new state. If you are questioned, you don't want to be hanging onto a Virginia driver's license.

Also, if your parents claimed you as a dependent for part of 2025, you are a resident wherever they are a resident for as long as you were their tax dependent.
