HALL OF SHAME: Cognizant
A federal court found Cognizant’s visa‑focused staffing model unlawfully disadvantaged non‑Indian and non–South‑Asian employees. About 2,300 class members are covered, with evidence showing non‑Indian workers were 8.4 times more likely to be terminated after benching. They told us we were lazy. They told us we lacked skill. They said Americans weren’t applying. But the truth just came out in federal court… A judge found that Cognizant’s internal policies- like “Visa Readiness” and “Bench Management” - were designed to favor H-1B visa holders from India, while disproportionately sidelining American workers. A statistical expert testified that the chances of Cognizant’s hiring patterns occurring randomly were “near zero.” Over 97% of Cognizant’s tech workforce came from a single region of India, primarily via referral networks. That’s not diversity. That’s discrimination. The lawsuit showed: • Americans were put on the bench while H-1Bs were assigned roles • Internal promotion paths favored Indian-born workers • Kickbacks and nepotism shaped who got hired and who got pushed out In December 2025, a federal judge ruled that Cognizant’s policies “had a discriminatory disparate impact” on non-South Asian, non-visa workers. The jury agreed. another lawsuit
Why Cognizant Is Being Sued for $380 Mn Lawsuit - Explained Clorox has taken Cognizant to court over a cybersecurity lapse it claims led to a massive data breach in 2023. The lawsuit alleges that Cognizant’s service desk handed over login credentials to a cybercriminal without basic identity checks, resulting in operational paralysis and $380 million in damages. The complainant claimed that Cognizant’s service desk failed to follow fundamental authentication procedure. It allowed a cybercriminal to infiltrate its systems in August 2023. The attacker posed as a Clorox employee and requested a password reset via phone, according to media reports. The lawsuit even stated that Cognizant support agent approved the request without performing necessary identity checks. “The resulting cyberattack was debilitating. It paralysed Clorox’s corporate network and crippled business operations,” the filing read, as quoted by reports. what happens when you outsource to India bodyshops. https://www.outlookbusiness.com/corporate/why-cognizant-is-being-sued-for-380-mn-lawsuit-explained |
| It's disappointing no one else is jumping on this. The discrimination we've looked away from is astounding. People it isn't racist to be appalled by this. |
| Chief District Judge Dolly Gee of the Central District of California ruled that Cognizant’s internal policies, including “Visa Readiness” and “Visa Utilization,” systematically pushed out non‑South Asian workers while protecting or favoring H‑1B employees—most from India—between December 15, 2016, and October 27, 2022, in violation of U.S. anti‑discrimination law. |
| Thank you for sharing this OP. A previous employer outsourced many of their services to Cognizant and it seemed questionable at the time— they jumped right on Cognizant- wonder how that’s working out for them now. |

The H‑1B pool was built through large numbers of petitions filed based on projected demand, sometimes when no concrete job existed.
– That practice conflicted with rules requiring a valid job offer for each petition. – Evidence included allegations of employees pressured to sign letters supporting H‑1B applications for roles that did not yet exist. The court found these practices tied directly to a pattern of layoffs that disproportionately affected American workers and other non‑visa staff. |

Same practice at Cap1.
Good thing I now make 2x. |
| Has anyone sued Freddie Mac or Fannie Mae for the same? I have a neighbor who held a very high status position at Freddie who did nothing. She never worked an 8 hour day and she was absolutely not working from home. That place has to be a joke. |
| I'm surprised there wasn't more fallout from the investigation the FBI conducted re the fraud with donations to the Telegu Association. |
Shouldn't those people be deported? Apple and Fannie Mae fired a bunch of people for related fraud. |
My neighbor who suddenly left Freddie in the spring is now at Cap1. Wonder if she's working the same 4-5 hours or less per day. |
working in financial services isn't the same as working on an assembly line. its about actual results, not time butt is in seat. |
Democrats don’t care about helpingUS citizens. That is racist to them |
We agree. I met a Chinese h1b visa worker with an accounting degree while on vacation in LA. There is absolutely no reason to hire an accountant as an h1b worker, we have plenty of accountants here. That whole program stinks and is an outlet for foreign frauds |
Usually it is an Indian driving the hiring. Call Sen Warner and kaine But they don’t care about helping Us workers. Too in debt to replacing US workers either h1bs |
