| We live in MD. Husband was recently laid off. He has been telecommuting for the past 5 years. His company's U.S. office was based on VA. He just submitted the MD unemployment application this week but we are now realizing it should probably be submitted for Virginia instead. Is there a way to cancel the MD application and resubmit in VA without messing up the process? We don't want to slow things down but also don't want to double dip or do anything shady. |
| No, you submit for your state of residence. He’s being taxed by Maryland. |
The google machine says otherwise. |
Untrue. When I lived in DC and was laid off by my Maryland employer, I received Maryland unemployment. While your husband's income is being taxed by Maryland, his employer paid into Virginia's unemployment insurance system. |
Is there a way in Beacon to cancel the application? He can also call the department of labor and cancel it. Anyway, you have to file claim certification each week to get paid in MD. So as long as your DH does not file, he will not be paid. He should go ahead and apply in VA. |
| He should ask his employer to advise. My husband was in a similar situation and was told that he should file “where the work orders originated,” not where we live. FYI his claim took more than 2 months to process. |
| We live in MD and my husband’s company was based in VA. He filed his unemployment with Maryland. He’s been receiving UI benefits from them. |
| He should be filing in MD. I live in DC and was laid off from a VA company three years ago. My unemployment was filed with and came from DC. |
| if you are let go and got severance package, can you still file unemployment benefit from MD right after laid-off or need to wait until the end of the severance period? |
My experience in Maryland is that you can file right away, but they won't start paying you until the severance is exhausted. (They determine this time by looking at your prior year's salary and prorating--so if you get $20K in severance and your prior year's pay was $100K, they'll calculate your severance as 1/5 of a year.) I was glad I filed before the severance was exhausted, because that meant that once I was actually eligible to receive $, the paperwork had already been done. |
I think this is correct. |
| Maryland and Virginia have reciprocity for unemployment, so you should be fine. |
was this recently? I was laid off in the height of covid in MD and it took 6 mos to get my unemployment but I figured they were backlogged. |
How do they know your severance? |
| Virginia’s unemployment system is the worst. Try to stick with Maryland. |
